BRETBY PARISH COUNCIL
MINUTES OF THE ORDINARY PARISH MEETING HELD
MONDAY 24th JANUARY 2022 AT 7:30pm
AT ST WYSTANS CHURCH, BRETBY

Present:  Cllr S Toone (Chairman), Cllr M Bridges, Cllr S Betteridge-Sorby, Cllr K Kemp, Cllr L Meyrick.

 In Attendance: Mrs J Storer – Clerk, Cllr Haines (to 7:58pm), Cllr Muller (to 7.52pm), Cllr Churchill (to 7:58pm).

21/837 Apologies
Apologies were accepted from Cllr Falder (personal).  
As a quorum was established, the Chair commenced the meeting.

21/838 Variation of Order of Business
There was no alteration to the variation of the order of business.

21/839 Declaration of Interests:
Cllrs considered their obligations relating to declaration of interests and no declarations were made at this point of the meeting.

21/840 Public Speaking

No matters were raised.

b) County Council and District Council members to raise any relevant matter

Cllr Muller apologised for the administrative delay in processing the parish council’s funding application for a new noticeboard, this has been remedied and funds should be with the parish council shortly. Funds are also available to assist towards any organised jubilee celebrations.

Operation London Bridge – DCC policy is being revisited and Cllr Muller informed that when information is available, this will be passed to the parish council.

Cllr Muller reported on his attendance at today’s budget meeting at DCC and informed that the highway budget will be tripled in an effort to tackle the numerous highway matters within the county.

Cllr Toone mentioned that several road signs within the parish are either leaning or missing; he has reported these and Cllr Muller agreed to follow up the reported matters; the Clerk will provide the reference numbers.

Cllr Churchill reported that staffing remains a problem at SDDC largely due to Covid and shortage of  HGV drivers, despite this the refuse bins are still being emptied. There are several planning vacancies which have been advertised and in the interim, some temporary staff have been brought into the planning dept.

SDDC’s bid made for SDDC zero emission vehicles has found support with the Council however, this will be a phased project with rural areas following after the urban areas.

Cllr Haines reported that reports of fly tipping are at the lowest level for 5 years.

Foremark Reservoir temporary fencing has been taken down and permanent fencing is being placed strategically.

There is a consultation about the Area Forum and all were urged to participate.

Cllr Toone and Cllr Betteridge-Sorby declared personal interests relating to ongoing problems with a particular site on Bretby Lane where alterations to the building have been taking place for over 18 months. Concerns were raised about parking of contractors vehicles, about safety of the site and general inconsideration of the contractors to residents.

Cllr Toone raised a query relating to the refusal of a particular planning application on Bretby Lane, the grounds for refusal were difficult to understand; particularly as the planning decision lacked consistency to previously granted permissions for similar extensions, including the those to the adjoining property.  District and County Cllrs reminded that planning decisions can be appealed and if residents are concerned about the quality of work being undertaken at any site, these can be raised with the Enforcement Officer. Problems relating to vehicles parking on pavements should be reported to the police.

c)         To consider the draft budget for 2022/23
The draft budget had been previously circulated to all Cllrs.  Cllrs considered the financial requirements of the parish council and the need to maintain appropriate levels of reserves as identified by the external auditors.  Cllrs debated at the length the priority of its expenditure and the financial impact upon residents of any increase the parish council may impose when taken in conjunction with rises from the other precepting authorities.
RESOLVED to set the precept for 2022/23 at £4,024.00.
The precept is to be increased by 10%, this represents an annual council tax bill of £9.72 for a Band D property. This increase is necessary to balance the budget, to prevent the depletion of the reserves and to take into account the impact of rising inflation.

The parish council has attempted to set up a group to organise activities and events but due to little or no support or interest from the community for any Jubilee celebrations, nor to assist with the organisation.  With the limited committed engagement of the community, the Jubilee activities will be limited. To fund these limited activities, the working party is to use the surplus funds from previous community events (£1400). There is no intention to come to the parish council for funding towards the celebrations; future approaches may be made to Cllr Muller for funding.  Cllr Kemp explained some of the possible Jubilee events including a beacon, a walk and a picnic.

BRETBY PARISH COUNCIL

MONDAY 22nd NOVEMBER 2021 AT 7:30pm

Present:  Cllr M Falder (Chairman), Cllr G Corner, Cllr M Bridges.

In Attendance: Mrs J Storer – Clerk, Cllrs Haines (to 8:14pm) and Muller (to 8:06pm), Cllr Churchill (to 8:14pm).

The venue had been unavailable for the meeting scheduled for 16th November 2021 and no alternative was available, which resulted in a change from the scheduled meeting date.

Cllr Muller reported that no new reports have been released relating to the Freeport. Cllr Churchill added that no business plan has been submitted yet. Concerns were raised by parish cllrs about:-

  • the level of infrastructure that will be essential in order to cope with additional industries and residential development taking place now and, in the future,
  • whether prompt action will be taken both by DCC and SDDC to ensure that the correct infrastructure requirements brought about by the Freeport status and by developments generally are put into place.

The future allocation of housing stock numbers which maybe impacted by the Freeport status and changes relating to HS2 is to be resolved in the next Local Plan.

The congestion caused by temporary traffic lights at the end of Geary Lane was raised at the last meeting, however since then, there have been additional temporary lights in other areas of the parish and in Burton, these too are causing frustrations to motorists.  Enquiries were made as to the necessity of temporary traffic lights at what appears to be every set of road works. Cllr Muller cited other examples of this problem and will raise it with the Highways Dept. 

The road markings at roundabout on the A5111 outside the Chesterfield Pub requires repainting.  Cllr Muller will take this matter to the Highways Dept.

The Newton Park Hotel has a contract to house immigrants seeking asylum.  Heather Wheeler MP has written to Cllr Muller to explain the security arrangements that have been put into place including a requirement for residents to observe an overnight curfew, any breach of which could affect their asylum application. If the asylum application is granted, successful people will be passed to another local authority for rehousing. No one present could provide any information as to whether any asylum seekers are being housed in Derbyshire.

Cllr Muller still has money left in his Community Fund; additional separate funds are to be made available for the Jubilee celebrations. An application to Cllr Muller’s Community Fund will be submitted for a new noticeboard on the Village Green.

SDDC will not make any changes to the waste collection routine over the Christmas period and instances of fly tipping can still be reported.  There remain staff shortages within the District Council and the Chairman congratulated SDDC in keeping the waste collections going through the pandemic and fuel crisis. There are also staff shortages in planning, with officers having up to double their caseloads; a duty planning system has been introduced to help resolve some of the service issues reported by those making planning applications. District Cllrs have fed back to the District Council the concerns expressed at the last parish council in relation to the large number of retrospective planning applications, not only being submitted but also of the high number of recitative applicants. Currently there are no solutions to the problem of the deliberate abuse of the planning system by those undertaking works and then seeking permission. 

The ground maintenance team has ceased mowing for the year and have converted to their winter schedule.

The Green Energy scheme operated by SDDC was explained and the Community Grant Scheme remains available.

The coffee pod recycling scheme has so far recycled ¼ million pods since April 2021.  Following a SDDC governance review, the Area Forum is now a Community Forum, the next meeting will be via Teams on 30th November.

Contacting SDDC officers often remains problematical and both District Cllrs acknowledged that there has been a drop in the level of service. Both have made representations about this and reported that SDDC staff may move to a hybrid working model shortly; however this proposal is still subject to agreement and approval.

There is now a SDDC mapping portal with further expansion of its information due next year.

Questions were raised about the District Council budget and financial robustness in light of the rising level of inflation and other economic and social pressures.  District Cllrs informed that there maybe a wage push at SDDC and at other authorities due to the increasing level of inflation, this coupled with the recycling contracts (which are coming to an end) no longer providing income means that there will be some significant cost pressures in the very near future.

The Chairman has been monitoring the bin collection at the Hall and reported that the bins are emptied quickly and efficiently and that there is no requirement for any increase in capacity at this location.  The order for bins to be placed on Bretby Lane is regularly pursued by the Clerk and in light of comments made by the District Cllrs about the drop in some areas of service level, the Clerk will ensure that both District Cllrs are copied into future enquiries about the bins.

There was a bomb scare on Bretby Lane about a month ago following the discovery of a hand grenade during building work at a house. The bomb disposal unit removed and safely disposed of the grenade.

During a very heavy rain storm early in the month, part of Geary Lane flooded with water running off the fields but it was flash flooding and quickly dispersed. All agreed that regularly cleaning and maintenance is now a thing of the past.
The SDDC Flood Liaison Meeting held via TEAMS 2nd November 2021 – no report was received.

All are urged to continue to exercise caution as Covid cases continues to rise.

BRETBY PARISH COUNCIL
MINUTES OF THE ORDINARY PARISH MEETING HELD
TUESDAY 14th SEPTEMBER 2021 AT 7:30pm

Present:  Cllr M Falder (Chairman), Cllr Meyrick, Cllr G Corner, Cllr S Betteridge-Sorby(to 8:33pm) , Cllr K Kemp, Cllr S Toone.

Cllrs considered their obligations relating to declaration of interests; Cllr Falder declared a prejudicial interest in planning application DMPA/2021/1231 as he is the applicant.

21/818 Public Speaking

b) County Council and District Council members to raise any relevant matter
The Chair introduced County Cllr Muller who gave a brief resume of his County Council responsibilities.
The business plan from the Freeport Governing Body was sent to Central Government on 10th September 2021; this will facilitate the release of information and of the governing arrangements for all to consider.  Cllr Muller has a community fund and a separate fund will be available later in the year for marking the Queen’s Jubilee. DCC has received approx. £1m for roofing and insulation upgrades subject to specific conditions; this grant funding is available until March 2022.
The Highways Dept (DCC) is proactive and any issues are requested to be reported as soon as they are known.  The Chair reported that the road side verge cutting had again been unpredictable over the summer with mowing taking place when the grass was short, then vegetation was left to grow exceptionally tall; adding that the height of the vegetation was of concern to highway safety.  SDDC has cut back on the number of cuts of the verges in order to encourage wildlife.  
Cllr Meyrick reported that he had reported directly via the DCC website, a problem with a manhole cover and this is still outstanding; Cllr Muller will follow up the matter.
The position of recent temporary lights on Geary Lane caused traffic to back up onto Ashby Road; the works have finished, Cllr Muller requested if there are any similar problems, these are to be reported to Cllr Muller at the time.
SDDC will be producing a booklet to PC which will outline all procedures necessary for the Jubilee.
Cllr Haines informed a report will be released in October about the District Council’s future working procedures.  A review is underway about the performance of the Planning Dept together with a report about options available in relation to retrospective planning applications; the number of which has significantly increased. Cllr Toone provided the parish council with a timeline and lack of correspondence in relation to the ongoing building works at 12 Bretby Lane.
The report on the impact of night flights will be reviewed by the Scrutiny Panel.

Cllr Betteridge -Sorby reported that a meeting was held last night about ideas for the next Jubilee.  The next meeting will be on 18th October.  11 persons in attendance at last night’s meeting which suggested holding the following:-

  1. A barn dance, although not necessarily on the Jubilee weekend
  2. Afternoon tea on the Saturday

Clarification was sought about public liability element; the Clerk provided guidance on this.

There is approximately £1490 from the last 3 community events which could be used for a future coronation event. The parish council currently has no earmarked reserves for the Jubilee although the parish council can precept for the event.  The next stage is to draft and print a leaflet to distribute and raise awareness of the meeting on 18th October and it is at this meeting that the arrangements will be decided.

Min 21/806 the bin is now with SDDC and the Clerk has provided SDDC with the location for it to be installed. The Clerk has circulated to Cllrs the cost of changing the new litter bin at Bretby Park to a larger bin. The Chair has been monitoring the volume of litter in the bins within Bretby Park with a view to making a decision about the request from the Hall for a larger bin to be installed. No decision was made by the Council about whether to change the bin but the use of the bin will be monitored over the next six months so a decision can be made in the spring.

No communication has been received from Crest since the last meeting (Min 21/796d)

No updates have been received about the unauthorised signs on Oldicote Lane (Min 20.755b)

The Chair extended the council’s congratulations to Cllr Betteridge-Sorby on receiving an OBE in the Queen’s Birthday Honours List.

21/798 Apologies
Apologies were noted from Cllrs Bridges, Churchill, Haines and Muller.  As a quorum was established, the Chair commenced the meeting.

Cllr Haines’ report had previously been circulated to all Cllrs and attached as Appendix 1.
Cllrs voiced disappointment that no progress has been made with the planning application and appeal related to applications along Bretby Lane.  Continued concerns were expressed about the work arrangements at 12 Bretby Lane and about the lack of interest shown by SDDC to the concerns raised by the parish council. The lack of communication from SDDC and DCC on this and other matters is extremely poor.
The lack of mowing at the top of Newton Lane and Knights Lane is creating a danger to motorists; the lack of mowing and the height of the grass obscures visibility.  The Clerk will send a letter of complaint to SDDC.
No County Cllr was in attendance and no report was provided.

c) Parish Council Members declaring an interest other than Disclosable Pecuniary Interest wishing to make representation
No representations were made.

Cllr Betteridge-Sorby reported on the meeting with a landowner who previously had expressed concern about dog fouling and anti social behaviour on his land (Min 21/796e). There is no bin facility along Bretby Lane. 
RESOLVED to install a large litter bin on Bretby Lane next to the parish council noticeboard.
The Clerk will approach Winshill parish council with a request to move the bin from Moat Bank to the entrance of Mimi’s Wood provided ESBC are willing to collect the waste.

The drain cover on Ashby Road East has been repaired (Min 20/755b).

No communication has been received from Crest since the last meeting (Min 21/796d)

No updates have been received bout the unauthorised signs on Oldicote Lane (Min 20.755b)

There have been expressions of interest and support for a parish event to commemorate the Platinum Jubilee next year.   Notices will be placed on Facebook by Cllrs Betteridge-Sorby and Kemp to invite and to gauge initial interest, to seek volunteers and to set an initial community meeting.  This will be a community led event, not a parish council event.

APPENDIX 1

District Council report for Bretby Parish Council meeting on Tuesday 13 July 

Foremarke Reservoir 
Over the weekend of 12 June there were serious parking problems at Foremark Reservoir due to high volumes of visiting members of the public with extensive parking on yellow lines and on overgrown grass verges. 28 fixed penalty notices were issued, and the road closed to prevent any other people attending. 

There were similar issues in summer 2020 after the first lockdown and several measures were put in place. These included adding double yellow lines outside the site, additional police patrols, additional car parking at the site and leaving the grass verges to grow so making them less appealing to park on. 

There have been relatively few problems at the site since these measures were put in place and Severn Trent, the police, SDDC Community Safety Enforcement Officers and DCC Civil Enforcement Parking Officers regularly communicate with each other and are making sure patrols are put in place when the weather is going to be hot.

Reopening after Covid
The local hospitality industry continues to cautiously reopen. There have been no significant anti-social behaviour issues or Covid breaches at licensed premises during recent Euro 2020 events. Just across the border in Donington Park, a smaller than normal Download festival was part of the government’s trials to enable large outdoor events to reopen safely. The Sausage and Cider festival, due to be held in June at Catton Park, was a casualty of the pandemic and had to be cancelled.

Night Flight Policy Consultation

The Government is consulting on the night flights policy – link below:

The closing date for the consultation is 3 September.  SDDC will put together a response to the consultation which will come to the Environmental committee in August for approval.

Planning application @ 12 Bretby Lane – DMPA/2021/0561
We are still waiting for a decision to come through on this application. The case officer is away until Monday so would expect some clarification this week and will update as soon as we hear anything.

Planning appeal @ Land at Rear of 101-119 Bretby Lane – DMPA/2019/1430
No decision from the Inspectorate to date. The case officer is going to try and contact the Inspectorate directly to see if we can get some more information.

Shades Farm
We have been contacted by residents who remain concerned about the new biomass boiler and ongoing planning applications at Shades Farm. We continue to reassure residents that the correct planning process is being followed and that the planning system does allow for retrospective applications to regularise any unauthorised development. We will continue to monitor things on a case-by-case basis and are happy to speak to any residents who may have concerns.

Area Forum Meetings
The next round of Area Forum meetings will take place in the Autumn and Chris Smith from SDDC should be in touch shortly with Parish Councils to confirm details.

Due to continuing Covid restrictions, no Covid safe venue was available within the Parish, the meeting was therefore held outside of the parish.

The Chair thanked all for attending and in particular thanked Cllr Betteridge-Sorby for arranging a covid compliant venue for the holding of Council meetings. He welcomed everyone back to the first face to face meeting in over 12 months.

The resurfacing of a section of Bretby Lane has been undertaken; Cllrs welcomed the quality of the repairs and thanked former County Cllr Chilton.

Members of the public have informed of significant queues and waiting times at the Newhall tip, discouraging people from taking items to the tip; this is thought to have contributed to the increase of flytipping around the parish.  The Clean Team has cleared reported instances of flytipping, putting increased pressure on already limited resources.  Around the parish there has been a significant increase in flytipping and across the district there has been a 40% increase.  The recycling contractor has ceased trading and the District Council stepped in to fulfil the recycling contract; the value of recycling has decreased and SDDC is undertaking studies about alternative recycling schemes in readiness for the renewal of the contract in the autumn.

DMPA/2021/0561:Amended scheme to previously approved DMPA/2019/1461 for the erection of an extension with pitch roof and the conversion of loft space at 12 Bretby Lane, Bretby, Burton upon Trent, DE15 0QN (12/05/21)
Some Cllrs expressed disappointment about the lack of response to correspondence sent to SDDC Planning Dept by residents relating to safety concerns and the continuation of building works, particularly on the roof, at the above property. The alleged disregard of the planning process, building inspection and safety was considered to debase the planning process.
District Cllrs reported that the Planning Dept has been in correspondence with the applicants but District Cllrs were unaware that residents’ correspondence had gone unanswered; they will follow up on these matter.
RESOLVED: objection; as it is overbearing presence on 10 and 19 Bretby Lane and newly installed windows overlook gardens and bedrooms which affects neighbours right to presence. This application goes against the previous planning conditions restricting the increase of the height of the property.

Cllr Falder was nominated by Cllr Bridges, seconded by Cllr Corner.  There were no other nominations.  Cllr Falder was unanimously elected as Chairman.
Cllr Falder thanked all for the support and confidence given to him in his capacity as Chairman and informed the meeting that this will be his final year as Chairman – next year he will step down as Chair but remain on the Council.

Cllr Falder took and signed the Declaration of Office for the position of Chairman.

The insurance falls due for renewal on 1st June 2021 and the renewal premium has been received and circulated to all Cllrs.  The insurance company has advised the Clerk that the premium is the lowest possible. The insurance cover provided was agreed and accepted by Cllrs.

21/780 Review of the Council’s and/or employees’ memberships of other bodies.
The Parish Council is currently a member of DALC and will continue to retain membership with DALC. The Clerk is a member of SLCC and this will continue.

The Chairman reported that this will be Cllr Chilton’s last attendance at Bretby Parish Council as she is not seeking re-election in May.  He expressed and conveyed his and the Council’s thanks and appreciation for her work for the parish.

Cllr Chilton asked if reported items from the last meeting have been resolved.
The grate cover on Ashby Road East – this remains a problem and is the responsibility of South Staffordshire Water.  Cllr Chilton will follow this matter.
The drain on the Repton/Hartshorne Road – this has been attended to promptly.
The drain on Knights Lane – this has dried up naturally but will potentially be a problem in the future. No officer has been in contact with the Chair despite his details being provided to officers.
Cllr Chilton reported on the changes within the Highways Dept (DCC) and is hopeful that some of the issues can now be resolved quickly.

Again, only those potholes which are reported to DCC are attended to but do not attend to the potholes that are seen but are unreported. A request was made for the repair team to attend to all potholes in the vicinity.
Cadent – no progress has been made and the resident is now almost unable to access his drive.  A team has previously visited and agreed to repair the bad workmanship on an “if and when” basis however there has been a lengthy wait with no action yet taken.  Cllr Chilton will pursue this.
Cllr Toone commented upon the amount of litter on the side of the A38 and commended a team for the work they undertook to clear litter from various sections of the A38.  A similar situation exists on the A50.
A sign has been erected on both sides of Oldicote Lane sign stating it is a private lane and access is only for residents; this sign is confusing as it has the appearance of an official council sign but isn’t.  An acknowledgement was made that the Lane is unadopted, narrow and difficult to turn a vehicle round however the sign is considered to be not only misleading but also officious; there is a public footpath at the end of the lane and therefore access if permitted. A photo of the sign will be forwarded to Cllr Chilton to follow the matter with Traffic Safety Dept and to make enquiries about obtaining a “No Turning” sign.

There is no stop sign or white lines at the junctions of the Nurseries or at Mount Lane, motorists continue to exit the Nurseries and pay little attention to traffic from the right, this has caused some issues.  There was disappointment that the Nurseries have not engaged to inform motorists to use care when exiting the site.

Cllr Churchill reported on the Freeport announcement made in the budget by the Secretary of State about three sites in the east midlands.  One site will be at Toyota with a rail head and will create about £12m additional business rates and 6000 new jobs.  There will however, be significant blight to residents in the area and SDDC will have to mitigate this for the residents.  For Bretby there could be increase aircraft noise. The Chairman asked for information about what infra structure upgrades will be installed.  The Dept of State and Highways England will make all the surveys and recommendations relating to changes in infrastructure.  The governance structure will come under the D2N2 LEP and there will be consultations for local residents. Flooding in Egginton is acknowledged to be of concern.  The Freeport status will bring significant tax breaks that could be used towards improving the infrastructure.

The appeal on affordable homes on Bretby Lane is still awaited.

The work taking place at 12 Bretby Lane is to be looked at by the Planning Enforcement Team. Cllr Toone reported that some demolition had taken place along with some development that does not appear to bear any resemblance to the original plans. Concerns were expressed about the impact on the telephone line by these works.  Cllr Haines encouraged people to report directly their concerns to the Enforcement Team as well as to Cllrs. The personnel situation in the Planning Dept was explained.
SDDC grass cutting schedule resumes this month.  No progress has been made about the request relating to the specific grass cutting on Watery Lane raised last year,  Cllr Chilton will follow this matter with DCC.
South Derbyshire will be part of a pilot scheme about the recycling of coffee pods.

A member of the public attending from Bretby Hall welcomed the co-operation about the issue of dog mess. The Clerk will continue to press SDDC for information as to when the bin will be installed.
During recent times there have been an increase in the use of the Hall carpark for people visiting the area for exercise and there has been an increase in anti social behaviour.  It was noted that the parish has previously been sheltered from anti social behaviour but is now exposed to it; some of the reported incidents are of concern. The feeling of the meeting was that this situation will continue and is likely to escalate post covid.
The Derbyshire Police Rural Crime publication has provided some guidance along with various contact numbers; this will be forwarded to the resident, however these matters including littering appear to be very low on the priority list for the police.

The Clerk’s report contained information about the future holding of meetings when the legislation for holding remote council meetings expires on 6th May.  There is to be a return to face to face meetings however Cllrs were concerned that other regulations will remain in force, causing conflicts and have the consequence that the holding of face to face meetings will be unachievable.  Cllrs expressed concerns that it may still not be safe to return to face to face meeting, and that by resuming physical meetings it may prevent some Cllrs and residents from their right to attend a meeting.
RESOLVED to acknowledge the legal situation, however  this parish council will meet remotely on 11th May 2021 unless clear guidance is received to the contrary.

Training is being provided remotely via Zoom.  The Clerk attended the DALC “Accounting for parish councils at the year end” training session on 22nd February 2021.

(d)        A resident at Bretby Hall has expressed a desire to join the parish council.  There are no vacancies at present.
A resident who owns Mimi Woods spoke with the Clerk today and the notes of that conversation (as approved by the resident) had been circulated to all Cllrs prior to the meeting.  One suggestion from the resident was to install a bin at an access point to the wood and Cllrs noted that the resident regularly places a black bin for the depositing of dog waste and that the majority of people do not use it to place the waste but discard it irresponsibly.
Similar experiences were noted by other landowners and the dog waste issue has been noted on social media.
It was AGREED that Cllrs Toone and Betteridge-Sorby will meet with the resident to discuss the situation.

(e)        The Clerk was asked to make a request for a speed check/monitor to take place on Bretby Lane.  Examples were given of a particular resident who speeds around the immediate area and information will also be passed to the PCSO.

Cllr Chilton reported that no further updates have been received relating to the condition of the Bretby Lane verge following works undertaken by Cadent; the promised meeting that would take place with DCC and the affected resident is still to be arranged. Dissatisfaction was expressed about the lack of communication from DCC with the resident.  Cllr Chilton agreed that the lack of communication was unacceptable; Cllrs also made comments on the road having sunk since the works have been completed. Cllr Chilton agreed to take the matter back to DCC as a matter of urgency.  

Disappointment was expressed about the lack of and lateness of gritting around the parish over the last two days when there was significant snowfall. The parish council owned grit bin at Watery Lane is filled occasionally from a store of grit kept at the Chairman’s property.  The second grit bin owned by the parish council is still located at the Chairman’s property and will continue to do so until an acceptable location can be found. Cllr Betteridge- Sorby raised the problems of lack of gritting on Midway Road, and asked that this is classed as a priority road whilst the vaccinations are taking place.

Funding is available from DCC relating to flooding, this information will be passed to the Clerk and the District cllrs.  There are not many properties in the parish that flood, flooding is not happening as badly on Bretby Lane as has been the case in previous years, possibly this is due to the recent planting of trees which appears to have helped to ease some of the flooding matters.

Cllr Chilton was requested to take the following matters to DCC: –
One drain outlet at Bretby Lane is blocked causing the water to back up and flood the lane; this matter goes back to 2019.
On Knights Lane a drain under the lane between Hill Farm and Newton Lane is blocked and floods the lane; it too requires clearing out; this matter is a highways safety issue as the standing water causes problems for traffic particularly if the water freezes.
A grid cover on Ashby Road East rattles when traffic goes over it, the matter has been on the repair list for a significant number of months.

Sub contractors have been seen repairing potholes yesterday and today in the snow.

Cllr Haynes reported that the snow over the weekend has meant no bin collections have taken place; SDDC will endeavour to catch up over the weekend.

Cllr Churchill reported that vaccinations at Oaklands are going well, as have the lateral flow testing centres in Swadlincote. 

Newton Lane is not flooding as in previous years and the recent engineering works appear to be working well; the quality of work was congratulated.

SDDC has confirmed that the verge at Watery Lane will not be cut as per the request of a resident; this request was made to protect the banks of the stream but confirmation on the new arrangement is still awaited from DCC – Cllr Chilton will follow this matter.

The street cleaning team have been seen in the parish, some local residents are using their daily exercise/walk to collect rubbish and the local volunteers collecting litter were congratulated.

Cllr Kemp informed that some residents have expressed a desire to carry out a community litter pick, Cllr Haynes will provide details of how to obtain the necessary equipment for this community activity to happen.

An update was requested on the appeal for the property development at Bretby Lane as it appears that the appeal was lodged after the time scales listed by SDDC in April 2020.

Cllrs Kemp and Betteridge-Storby have previously discussed how to increase the profile of the Facebook page, including highlighting the community litter pick and once interaction takes place, to establish a social committee and to increase the possibility of organising large events such as Bretby in Bloom.  Details of the Bretby Facebook page will be included in the Church newsletter.      Communication about the Bretby Facebook page was offer to be undertaken by the Neighbourhood Watch.

Cllr Haines thanked Cllr Falder for laying the wreath on behalf of SDDC on Remembrance Sunday.  The calendar for the bin collections for 2020/21 have been circulated and Cllr Haines will attend the Christmas waste meeting tomorrow and feedback any updates. Recycling remains very heavy and this has affected the green bin collections.
The Shades Farm planning application DMPA/2020/0933 was approved by SDDC Planning Committee with a number of conditions, these were listed to the meeting; building has commenced. The other applications at Shades Farm are submitted under permitted development.  Any concerns about the decisions can discuss these with Cllr Haines.
Cllrs Haines and Churchill have spoken with residents relating to the planning application DMPA/2020/0944 at 252 Bretby Lane and assured residents that despite Covid 19, the planning process remains rigour. The Planning Officer is awaiting information from the Highways Dept.
There was a major flytipping incident on Watery Lane two weeks ago.  The Clean Team was contacted and cleared the site very quickly.  Minor littering and fly tipping continue to be reported to the Clean Team who will follow up any information reported to them.  Flytipping is a problem across the district; particularly badly affected are those areas close to the Derby boarder.

Cllr Chilton reported on personnel changes within the Highways Dept. The number of children now in care specifically related to domestic abuse during Covid has risen.
The Vision Derbyshire suggestion was explained.
Cllr Chilton reported that she has received nothing back from DCC nor Cadent regarding members of the public concerns regarding Cadent quality and inconsiderate workmanship.  One member of the public is considering seeking assistance of the Ombudsman following the lack of response to his concerns.  Questions were raised about how Cadent continues to be failed to be held to account for their allegedly poor workmanship; Cllr Chilton will raise this matter with the new Highways Manager.

The public health roll out of the Covid vaccine has been advised that the Rosliston Forestry Centre is likely to be the vaccine centre for this area, however from a public transport perspective it is a difficult site to access with the buses being periodical and having the result of many people waiting at the vaccine centre for a number of hours.  Cllr Chilton will raise these concerns and feedback any comments via the Clerk.

The Clerk circulated an email on 5/10/20 about how the Council can communicate to its stakeholders, the recommendation is for a communications strategy to be drafted and to consider means of communication as per Cllr Kemp’s earlier suggestion.  A Facebook page has been set up and regular relevant updates are required to encourage people to be involved.  When the Facebook page was set up the Nurseries were invited to participate but they did not become involved, they will be asked if they now wish to contribute, a request will also be extended to the businesses at the Bretby Business Centre.  Promotion between the Facebook page and website will occur.  When Bretby in Bloom takes place, the Nurseries will be approached to assist.  The communication strategy and Bretby in Bloom will be considered in detail in the new year.

A lot of momentum for running organisations and events in the community has been lost with the pandemic and concerns were expressed that this momentum will not return, it is therefore necessary to communicate with the community to encourage others to carry on the community events and activities.

20/703 Apologies
Apologies were noted from Cllr Churchill.  As a quorum was established, the Chairman commenced and welcomed everyone to the meeting.

Cllrs considered their obligations relating to declaration of interests; no declarations were received.

20/706 Public Speaking

No matters were raised.

b) County Council and District Council members to raise any relevant matter
Cllr Haines updated that the Shades Farm planning application has been requested to go before the Planning Committee following the volume of local concerns expressed to both Parish and District Cllrs.  The Planning Officer is waiting for information from the applicant’s agent and it is therefore likely that the application will be brought before the October planning meeting.  The Enforcement Officer is looking at one application as the location of a barn is not in exactly the location as approval was granted.
The Chair provided some background relating to the concerns expressed by local residents during the summer and of the site meeting held with residents, District cllrs and the applicant.
SDDC is still meeting remotely with a lot of officers working from home.
Green bins – the amount of recycling has significantly increased over the last 6 months through Covid; equating to approx. the recycling collections from another 10,000 properties; the contractor has been struggling and there have been some missed collections but the problem has been resolved.
Examples were given of SDDC awarded grant funding projects.
Questions were raised with the funding reserves of SDDC; Cllr Haines reported that funds have been spent through Covid and SDDC awaiting to see what the financial position will be as Covid continues.
There have been major roadworks along Bretby Lane over a number of weeks, these have created problems for residents.

7.44pm Cllr Chilton joined the meeting.

There are traffic lights on Ashby Road East and Bretby Lane in place for work undertaken by Cadent and these lights have been in situ since February and are creating chaos.  The traffic lights are not synchronised and the organisation and execution of the works were considered to be appalling.  One resident has reported damage to his drive caused by traffic being diverted along his drive. Cllr Chilton provided examples of other examples of poor workmanship.  The safety of pedestrians was also thought to be compromised as the signage is not adequate and pedestrians are walking in the path of vehicles.
The Clerk was requested to write to the Highway Hub, copying in Cllr Chilton, to complain about the situation and ask for the officer to come to the location on an urgent basis
The volume and weight of traffic has also made the road sink leaving a significant drop from household drives onto Bretby Lane.
Speeding is still an issue along Bretby Lane between Bretby Nurseries to the end of Bretby Lane.  The Chair gave a short explanation of the attempts made by the Parish Council to have the speed limit introduced.  It is not possible to narrow the road to create a pavement on both sides of Bretby Lane.
The Clerk circulated an email from DCC about the creation of Vision Derbyshire and Cllr Chilton provided further information relating to the forthcoming Government White Paper on devolution.  This Vision for Derbyshire is being put forward to the Secretary of State and if  unacceptable then there is a “Plan B” that Derbyshire joins to form an  East Midlands group.  This may not impact significantly on parish councils; the majority of changes will impact on District and County Councils.

8:15pm Cllr Chilton and Cllr Haines left the meeting.

Discussions focused on the potential of noise and smell population, the material which may be burnt in such an incinerator, the location to several residential properties
RESOLVED: no planning reasons could be seen to object but SDDC planners were asked to  pay attention to any noise and/or odour pollution and to  monitor these.  SDDC will be asked to provide information as to how these items will be monitored.

The NALC national salary award had been circulated with the meeting papers.
The Clerk offered to leave the meeting for Cllrs to discuss the salary award. The Clerk was requested to remain at the meeting.
RESOLVED to adapt the recommendation of NALC and to award the 2.75% increase, back dated to 1st April 2020.
