MINUTES OF THE ANNUAL PARISH MEETING HELD
TUESDAY 17th MAY 2022 AT 7:10pm
AT ST WYSTANS CHURCH, BRETBY

Present:  Cllr M Falder (Chairman), Cllr M Bridges, Cllr S Betteridge-Sorby, Cllr S Toone, Cllr G Corner.

In Attendance: Mrs J Storer – Clerk, Cllr K Haines.

1. Election of Chairman
Cllr Falder reported that he will not stand for Chairman.
RESOLVED Cllr Toone was elected as Chairman

2. Chairman to take and sign the Declaration of Office
Cllr Toon took and signed the Declaration of Office of Chair of the Parish Council.

3. Election of Vice Chairman
RESOLVED Cllr Meyrick was elected as Vice Chairman
Cllr Meyrick had sent his apologies and had expressed an interest in becoming the Vice chair.

4. Vice Chairman to take and sign the Declaration of Office
Cllr Meyrick was not in attendance and will sign the Declaration of Office of Vice Chair as soon as possible.

5. Review/Completion of Register of Interests
No changes were made to the Register of Interests.

6. Appointment of Committees – if required
RESOLVED no committees were formed

7. Appointment of Cllrs to External Bodies and arrangements for reporting back
RESOLVED any Cllr will attend any meetings.

8. To review the Standing Orders
RESOLVED no changes were made to the Standing Orders which had previously been circulated.

9. To review the Financial Regulations
RESOLVED no changes are to be made to the Financial Regulations.

10. Review of polices and to adopt the new Code of Conduct 2021.
RESOLVED there are no changes to the parish council’s policies.
RESOLVED to adopt the new Code of Conduct 2021 as previously circulated.

11. Review of inventory of land and assets.
The inventory of land and assets had been circulated with the accounts for the year ending 31.03.22.  The inventory was accepted.

12. Review and confirmation of arrangements for insurance cover in respect of all insured risks.
RESOLVED the level of insurance cover was agreed and the Clerk was instructed to accept the lowest quote that was available to provide the agreed cover.

13. Review of the Council’s and/or employees’ memberships of other bodies.
RESOLVED to continue with membership of DALC and SLCC.

14. Reviewing the Council’s complaints procedure.
RESOLVED to continue with the complaints procedure with no changes.

There being no other business, the Chair closed the meeting at 7:19pm.

2. To receive the Annual report for 2021/22 – Cllr Falder

Last year was the recovery phase after Covid and during this time the parish has recovered and regrouped.  Unfortunately, the District Council has let the parish council down over the last 12 months, mainly relating to planning matters, people should be in the office or answering phones or responding to public responses.  This is very frustrating that this is not the case and it is extremely difficult to have any communication with any officer. The concerns about the lack of response from the planning dept could not be overstated.

It is disappointing that as a parish, we have been unable to come together for the Jubilee event, efforts have been made but the support has been poor.  There will be small individual events taking place, but no one community event has been organised.

We look forward to the trials of the speed indicator signs, speeding has been a long standing problem.

Thank you to the Clerk for her work over the last 26 years and to the District Cllrs who have responded to queries and concerns.

We are in times of change and changes are to be accepted as long as they are done in a controlled way.

The Clerk submitted an application on 23rd November 2021 to Cllr Muller’s Community Fund for funding towards a new noticeboard; £1,000 was received on 24th January 2022 for funding towards a new noticeboard.
Dog bin – the bin has been ordered and was installed close to the noticeboard on Oldicote Lane.

No changes are recommended and there are no reports of any breaches.  Recently there have been some reports locally of GDPR breaches and in light of this, the Clerk requested Cllrs to exercise caution with data that comes into their possession

The Code of Conduct has been updated and the new Code of Conduct is attached with the meeting papers.  The recommendation is for the new Code of Conduct to be adopted at the May 2022 Annual Meeting of the Parish Council.

MONDAY 14th MARCH 2022 AT 7:30pm

Present:  Cllr M Falder (Chairman), Cllr M Bridges, Cllr L Meyrick, Cllr S Toone.

21/853 Apologies
Apologies were accepted from Cllr Kemp (personal), Cllr Muller, Cllr S Betteridge-Sorby (personal), Cllr G Corner (personal), Cllr A Churchill.
As a quorum was established, the Chair commenced the meeting.

21/854 Variation of Order of Business
There was no alteration to the variation of the order of business.

21/855 Declaration of Interests:
Cllrs considered their obligations relating to declaration of interests and no declarations were made.

21/855 Public Speaking

a) Members of the Public and Council to comment on any matter
No matters were raised.

b) County Council and District Council members to raise any relevant matter

Cllr Muller had previously sent a report which had been circulated to Cllrs as follows:-

The Council Tax has been fixed at 3% for the following year. This includes 1% for Adult care.
Highways issues. I think everything has been logged.
The increase in the Highways budget has been welcomed with various road repairs being planned. I have a record of resurfacing to be done on both sides of the Green in Bretby .No time given.
Freeport.  Last month the East Midlands Freeport secured formal Government approval for its plans to offer businesses locating in the Freeport special incentives. The Freeport is set to deliver over 61,000 jobs for the East Midlands and an extra £8.4bn for the local economy over the next 30 years.
I have been informed that the Police Commissioner would like to visit our area to discuss various matters including speeding and ASB. I will report back on how and where we do this.
Friday 11th March, I was told a trial to promote the use of Speed Indicator Device signs (SIDs) will launch soon. The Clerk will receive information direct from Matlock.

Cllr Haines reported that a new water bottling plant is permitted in Foston, this will supply all the Lidl stores in the country.

The latest Local Plan has commenced and Cllr Haines will regularly keep the parish council up to date with relevant information.

Difficulties with the planning dept were aired by parish cllrs; Cllr Haines informed that there is a backlog of 700 planning applications and some agencies have offered to assist however this option is very expensive and recruitment remains the preferred option of SDDC.  A plan to resolve the situation is being considered at SDDC next month. The frustrations of these delays and the possible implications arising from the delays were voiced at the meeting.

Cllr Haines was asked if the District Council’s budget will be revised in light of the economy.  She informed that there are some reserves that can SDDC can use.  The reserves are not unlimited but the Council officers have in the past been both prudent in their management of funds and risk adverse, meaning that the District Council is in a relatively good position at this time.  The global situation regarding the economy and the potential of war will be continually monitored.

Easter holiday school food provision has been approved following the success of the summer school holiday provision.

A new tree policy has been adopted and works have been identified across the district on public grounds to trees.  This is accepted to be a large project.

Levelling up – this is co-ordinated by DCC and information may be available soon, SDDC has not been involved in it so far.

Freeport, there is little information from SDDC and any updates will be provided to the Clerk. A request was made for improved infrastructure.

It is thought that the new Government scheme for Ukrainian refugees will be co-ordinated by DCC.

7.53pm Cllr Haines left the meeting.

The Chairman has liaised with a local contractor about the replacement of the old noticeboard on the Village Green.
The Chairman expressed his support and thanks for Cllr Kemp’s efforts to organise a Jubilee event, noting that support for her and the event has been extremely limited.

The Clerk’s report as previously circulated was accepted with no further comments.

Request for extension made 7th February 2022 and received to allow Council to consider the application at the March Parish Council meeting
RESOLVED to make the comments.
The extension will about double the size of the existing property. And will impact upon neighbours right to light and privacy.  The parish council is concerned about the limitation to light due to the size and height of the extension wall.  The proposed extension is particularly intrusive to the neighbours.  There are also issues about ground support and stability – the patio will be 8’ higher than the neighbours, is there proper engineering in place to support the raising of the ground and to prevent land slippage.

RESOLVED: Concerns were raised about the stability of the ground as the proposed development is on the form Nadine pit. The Business Park is a busy site and concerns were expressed about the increase in vehicle movements  that will be using the access to and from the site.

Cllr Muller apologised for the administrative delay in processing the parish council’s funding application for a new noticeboard, this has been remedied and funds should be with the parish council shortly. Funds are also available to assist towards any organised jubilee celebrations.

Operation London Bridge – DCC policy is being revisited and Cllr Muller informed that when information is available, this will be passed to the parish council.

Cllr Muller reported on his attendance at today’s budget meeting at DCC and informed that the highway budget will be tripled in an effort to tackle the numerous highway matters within the county.

Cllr Toone mentioned that several road signs within the parish are either leaning or missing; he has reported these and Cllr Muller agreed to follow up the reported matters; the Clerk will provide the reference numbers.

Cllr Churchill reported that staffing remains a problem at SDDC largely due to Covid and shortage of  HGV drivers, despite this the refuse bins are still being emptied. There are several planning vacancies which have been advertised and in the interim, some temporary staff have been brought into the planning dept.

SDDC’s bid made for SDDC zero emission vehicles has found support with the Council however, this will be a phased project with rural areas following after the urban areas.

Cllr Haines reported that reports of fly tipping are at the lowest level for 5 years.

Foremark Reservoir temporary fencing has been taken down and permanent fencing is being placed strategically.

There is a consultation about the Area Forum and all were urged to participate.

Cllr Toone and Cllr Betteridge-Sorby declared personal interests relating to ongoing problems with a particular site on Bretby Lane where alterations to the building have been taking place for over 18 months. Concerns were raised about parking of contractors vehicles, about safety of the site and general inconsideration of the contractors to residents.

Cllr Toone raised a query relating to the refusal of a particular planning application on Bretby Lane, the grounds for refusal were difficult to understand; particularly as the planning decision lacked consistency to previously granted permissions for similar extensions, including the those to the adjoining property.  District and County Cllrs reminded that planning decisions can be appealed and if residents are concerned about the quality of work being undertaken at any site, these can be raised with the Enforcement Officer. Problems relating to vehicles parking on pavements should be reported to the police.

The draft budget had been previously circulated to all Cllrs.  Cllrs considered the financial requirements of the parish council and the need to maintain appropriate levels of reserves as identified by the external auditors.  Cllrs debated at the length the priority of its expenditure and the financial impact upon residents of any increase the parish council may impose when taken in conjunction with rises from the other precepting authorities.
RESOLVED to set the precept for 2022/23 at £4,024.00.
The precept is to be increased by 10%, this represents an annual council tax bill of £9.72 for a Band D property. This increase is necessary to balance the budget, to prevent the depletion of the reserves and to take into account the impact of rising inflation.

The parish council has attempted to set up a group to organise activities and events but due to little or no support or interest from the community for any Jubilee celebrations, nor to assist with the organisation.  With the limited committed engagement of the community, the Jubilee activities will be limited. To fund these limited activities, the working party is to use the surplus funds from previous community events (£1400). There is no intention to come to the parish council for funding towards the celebrations; future approaches may be made to Cllr Muller for funding.  Cllr Kemp explained some of the possible Jubilee events including a beacon, a walk and a picnic.

Actions raised at the last meeting have been attended to. 

The Clerk submitted an application on 23rd November 2021 to Cllr Muller’s Community Fund for funding towards a new noticeboard. No confirmation or funds have yet been received, but Cllr Muller’s email of 24th November 2021 states that £1,000 could be provided towards the project.

Dog bin – the bin has been ordered, the Clerk continues to chase SDDC on this matter and copies in both District Cllrs to any correspondence relating to this project. The Clerk wrote to Mr Simpkins on 1st December 2021 to provide an update on the order and when SDDC responds, a further update will be provided to Mr Simpkins.

MINUTES OF THE ORDINARY PARISH MEETING HELD
MONDAY 22nd NOVEMBER 2021 AT 7:30pm

Present:  Cllr M Falder (Chairman), Cllr G Corner, Cllr M Bridges.

In Attendance: Mrs J Storer – Clerk, Cllrs Haines (to 8:14pm) and Muller (to 8:06pm), Cllr Churchill (to 8:14pm).

The venue had been unavailable for the meeting scheduled for 16th November 2021 and no alternative was available, which resulted in a change from the scheduled meeting date.

Cllr Muller reported that no new reports have been released relating to the Freeport. Cllr Churchill added that no business plan has been submitted yet. Concerns were raised by parish cllrs about:-

  • the level of infrastructure that will be essential in order to cope with additional industries and residential development taking place now and, in the future,
  • whether prompt action will be taken both by DCC and SDDC to ensure that the correct infrastructure requirements brought about by the Freeport status and by developments generally are put into place.

The future allocation of housing stock numbers which maybe impacted by the Freeport status and changes relating to HS2 is to be resolved in the next Local Plan.

The congestion caused by temporary traffic lights at the end of Geary Lane was raised at the last meeting, however since then, there have been additional temporary lights in other areas of the parish and in Burton, these too are causing frustrations to motorists.  Enquiries were made as to the necessity of temporary traffic lights at what appears to be every set of road works. Cllr Muller cited other examples of this problem and will raise it with the Highways Dept. 

The road markings at roundabout on the A5111 outside the Chesterfield Pub requires repainting.  Cllr Muller will take this matter to the Highways Dept.

The Newton Park Hotel has a contract to house immigrants seeking asylum.  Heather Wheeler MP has written to Cllr Muller to explain the security arrangements that have been put into place including a requirement for residents to observe an overnight curfew, any breach of which could affect their asylum application. If the asylum application is granted, successful people will be passed to another local authority for rehousing. No one present could provide any information as to whether any asylum seekers are being housed in Derbyshire.

Cllr Muller still has money left in his Community Fund; additional separate funds are to be made available for the Jubilee celebrations. An application to Cllr Muller’s Community Fund will be submitted for a new noticeboard on the Village Green.

SDDC will not make any changes to the waste collection routine over the Christmas period and instances of fly tipping can still be reported.  There remain staff shortages within the District Council and the Chairman congratulated SDDC in keeping the waste collections going through the pandemic and fuel crisis. There are also staff shortages in planning, with officers having up to double their caseloads; a duty planning system has been introduced to help resolve some of the service issues reported by those making planning applications. District Cllrs have fed back to the District Council the concerns expressed at the last parish council in relation to the large number of retrospective planning applications, not only being submitted but also of the high number of recitative applicants. Currently there are no solutions to the problem of the deliberate abuse of the planning system by those undertaking works and then seeking permission. 

The ground maintenance team has ceased mowing for the year and have converted to their winter schedule.

The Green Energy scheme operated by SDDC was explained and the Community Grant Scheme remains available.

The coffee pod recycling scheme has so far recycled ¼ million pods since April 2021.  Following a SDDC governance review, the Area Forum is now a Community Forum, the next meeting will be via Teams on 30th November.

Contacting SDDC officers often remains problematical and both District Cllrs acknowledged that there has been a drop in the level of service. Both have made representations about this and reported that SDDC staff may move to a hybrid working model shortly; however this proposal is still subject to agreement and approval.

There is now a SDDC mapping portal with further expansion of its information due next year.

Questions were raised about the District Council budget and financial robustness in light of the rising level of inflation and other economic and social pressures.  District Cllrs informed that there maybe a wage push at SDDC and at other authorities due to the increasing level of inflation, this coupled with the recycling contracts (which are coming to an end) no longer providing income means that there will be some significant cost pressures in the very near future.

The Chairman has been monitoring the bin collection at the Hall and reported that the bins are emptied quickly and efficiently and that there is no requirement for any increase in capacity at this location.  The order for bins to be placed on Bretby Lane is regularly pursued by the Clerk and in light of comments made by the District Cllrs about the drop in some areas of service level, the Clerk will ensure that both District Cllrs are copied into future enquiries about the bins.

There was a bomb scare on Bretby Lane about a month ago following the discovery of a hand grenade during building work at a house. The bomb disposal unit removed and safely disposed of the grenade.

MINUTES OF THE ORDINARY PARISH MEETING HELD
TUESDAY 14th SEPTEMBER 2021 AT 7:30pm
AT ST WYSTANS CHURCH, BRETBY

Present:  Cllr M Falder (Chairman), Cllr Meyrick, Cllr G Corner, Cllr S Betteridge-Sorby(to 8:33pm) , Cllr K Kemp, Cllr S Toone.

In Attendance: Mrs J Storer – Clerk, Cllrs Haines (to 8:33pm) and Muller (to 8:03pm).

21/815 Apologies
Apologies were noted from Cllr Churchill and Cllr Bridges.  As a quorum was established, the Chair commenced the meeting.

21/816 Variation of Order of Business
There was no alteration to the variation of the order of business.

21/817 Declaration of Interests:
Cllrs considered their obligations relating to declaration of interests; Cllr Falder declared a prejudicial interest in planning application DMPA/2021/1231 as he is the applicant.

21/818 Public Speaking

No matters were raised.

b) County Council and District Council members to raise any relevant matter
The Chair introduced County Cllr Muller who gave a brief resume of his County Council responsibilities.
The business plan from the Freeport Governing Body was sent to Central Government on 10th September 2021; this will facilitate the release of information and of the governing arrangements for all to consider.  Cllr Muller has a community fund and a separate fund will be available later in the year for marking the Queen’s Jubilee. DCC has received approx. £1m for roofing and insulation upgrades subject to specific conditions; this grant funding is available until March 2022.
The Highways Dept (DCC) is proactive and any issues are requested to be reported as soon as they are known.  The Chair reported that the road side verge cutting had again been unpredictable over the summer with mowing taking place when the grass was short, then vegetation was left to grow exceptionally tall; adding that the height of the vegetation was of concern to highway safety.  SDDC has cut back on the number of cuts of the verges in order to encourage wildlife.  
Cllr Meyrick reported that he had reported directly via the DCC website, a problem with a manhole cover and this is still outstanding; Cllr Muller will follow up the matter.
The position of recent temporary lights on Geary Lane caused traffic to back up onto Ashby Road; the works have finished, Cllr Muller requested if there are any similar problems, these are to be reported to Cllr Muller at the time.
SDDC will be producing a booklet to PC which will outline all procedures necessary for the Jubilee.
Cllr Haines informed a report will be released in October about the District Council’s future working procedures.  A review is underway about the performance of the Planning Dept together with a report about options available in relation to retrospective planning applications; the number of which has significantly increased. Cllr Toone provided the parish council with a timeline and lack of correspondence in relation to the ongoing building works at 12 Bretby Lane.
The report on the impact of night flights will be reviewed by the Scrutiny Panel.

These were circulated, read, approved and signed as a correct record by Cllr Falder.

21/814 To receive the Chairman’s Announcements
No announcements were made.

Cllr Betteridge -Sorby reported that a meeting was held last night about ideas for the next Jubilee.  The next meeting will be on 18th October.  11 persons in attendance at last night’s meeting which suggested holding the following:-

  1. A barn dance, although not necessarily on the Jubilee weekend
  2. Afternoon tea on the Saturday

Clarification was sought about public liability element; the Clerk provided guidance on this.

There is approximately £1490 from the last 3 community events which could be used for a future coronation event. The parish council currently has no earmarked reserves for the Jubilee although the parish council can precept for the event.  The next stage is to draft and print a leaflet to distribute and raise awareness of the meeting on 18th October and it is at this meeting that the arrangements will be decided.

8:33pm Cllr Haines and Cllr Betteridge -Sorby left the meeting.

The Clerk’s report as previously circulated was accepted with no further comments. 
Min 21/806 the bin is now with SDDC and the Clerk has provided SDDC with the location for it to be installed. The Clerk has circulated to Cllrs the cost of changing the new litter bin at Bretby Park to a larger bin. The Chair has been monitoring the volume of litter in the bins within Bretby Park with a view to making a decision about the request from the Hall for a larger bin to be installed. No decision was made by the Council about whether to change the bin but the use of the bin will be monitored over the next six months so a decision can be made in the spring.

No communication has been received from Crest since the last meeting (Min 21/796d)

No updates have been received about the unauthorised signs on Oldicote Lane (Min 20.755b)
