BRETBY PARISH COUNCIL
MINUTES OF THE ORDINARY PARISH MEETING HELD
TUESDAY 10th JANUARY 2023 AT 7:30pm
AT ST WYSTANS CHURCH, BRETBY

Present:  Cllr S Toone (Chairman), Cllr M Falder, Cllr M Bridges, Cllr Corner, Cllr Meyrick.

In Attendance: Mrs J Storer – Clerk, Cllr Haines (to 8:22 pm),

22/919 Apologies
Apologies were noted from Cllr Churchill and Cllr Muller.
As a quorum was established, the Chair commenced the meeting.

22/920 Variation of Order of Business
There was no alteration to the variation of the order of business.

22/921 Declaration of Interests:
Cllrs considered their obligations relating to declaration of interests.  No declarations were made.

22/922 Public Speaking

a) Members of the Public and Council to comment on any matter
No matters were raised.

b) County Council and District Council members to raise any relevant matter

Cllr Haines reported on the Local Plan latest consultation stage which has finished and highlighted the next stages; dates of which are unknown. Cllrs expressed concerns about a site put forward at Brizlincote Valley; concerns were on the accuracy of information contained about the site and the size of the area put forward – which if successful, has the potential to increase by three fold, the number of current properties in the parish.
Discussion took place about the possible impact upon the target housing numbers and identified sites across the district, should the various bills relating to planning and the Government’s levelling up agenda be passed,

The next area forum meeting is on 14th February in Findern Village Hall at 6.30pm.

A request for an update on the planning appeal at The Lodges on Knights Lane (Below under PLANNING) noted that the grounds for appeal are unknown. Cllrs raised their concerns that the dates on the planning portal are unreliable and there are still huge delays in the dealing with planning application.  Difficulties remain in recruitment and retention of planning officers, both locally and nationally which continues to impact upon the service levels and timeframes on all planning matters.

The District Council’s CEO post has been advertised; as it is unlikely that a successor will be in post before the retirement of the current CEO at the end of March, plans are being considered for an interim CEO.

Cllr Haines will make enquiries about a District Council scheme for free insulation and boilers and pass this information to the Cllrs.

The Newton Park, Newton Solney has had its licence renewed for SERCO to continue using the hotel for asylum seekers.

The carpark next to the Chesterfield Pub is in a poor condition and has become an eyesore.

Outside the Golf Club a manhole is slowing deteriorating.  Cllrs commented upon the condition of roads which are generally in a poor condition around the parish and district.

Cllr Haines will make enquiries if there are any District Council plans to celebrate the coronation.

c) Parish Council Members declaring an interest other than Disclosable Pecuniary Interest wishing to make representation
No representations were made.

22/923 To approve the Minutes of the Ordinary Meeting of the Parish Council held on 5th October 2022
These were circulated, read, approved and signed as a correct record by Cllr Toone.

22/924 To determine which items if any, should be taken with the public excluded.
No items were deemed necessary to be taken with the public excluded other than that listed on the agenda.

22/925 To receive the Chairman’s Announcements
The Chair attended the last Area Forum meeting and made representations about parking on Bretby Lane,  It was agreed at that meeting that the police would assess the situation, whilst some visits have been made by the police, poor and inconsiderate parking still occurs.  This will be raised at the next Area Forum.

22/926 To receive the Report of the Clerk
The Clerk’s report as previously circulated was accepted with no further comments. 

22/927 Governance

a) Risk Register update
There are no recommended changes to the risk register.
RESOLVED to make no changes to the risk register.

b)  General Data Protection Regulations (GDPR)
No changes are recommended and there are no reports of any breaches. 

c)  Parish Cllr vacancy and attendance
No persons have applied to be co-opted to fill the vacancy created by Cllr Kemp.  Cllr Betteridge-Sorby resigned on 2nd January 2023; the Elections Officer has been informed.  As there is less than 6 months to the parish council elections, there is no necessity for the parish council to actively seek to fill the two vacancies on the parish council.

d)  To agree the new Equality policy
The draft Equality Policy had been previously circulated to all Cllrs.
RESOLVED to adopt the Equality Policy as circulated.

22/928 Drainage and flooding issues
No matters were raised; Watery Lane culvert has been repaired and blockages cleared.

c)  To set the precept for 2023/24
The budget for 2023/24 had been circulated to Cllrs with the meeting papers.  Cllrs studied the budget and considered various scenarios (current and future) that would be required to achieve a breakeven budget for the forthcoming financial year and the impact upon the Council’s future finances.  The level of reserves was noted together with the advice given about the level of reserves required to be held. It was agreed that the required percentage increase in the precept needed to achieve a break even budget for the financial year 2023/24 was high given the current economic climate and for this year, a negative budget will be set with the budget deficit being met from reserves.
RESOLVED to accept the budget for 2023/24.
RESOLVED to set the precept for 2023/24 at £4185.00. This is 4%, increase.

Training sessions are listed on DALC circulars and in a specific email circulated to Cllrs on 16th December 2022.
No training sessions have taken place since the last meeting.

(d)  A resident is undertaking the Duke of Edinburgh Award, the Parish Council thanked her and approved the 2023 litter picking she undertook as part of the community element of the DoE Award.

(e)  Cllr Falder and his sister are arranging and hosting on an event for the Coronation; detailed were provided; the event will be publicised via social media and word of mouth.  The event will be on 8th May for Bretby parishioners.

22/934 Date of next meeting
The next Parish Council meeting will be held on at Monday 27th March 2023 at 7.30pm at St Wystan’s Church, Bretby. 

22/935 EXEMPT
RESOLVED to move the following resolution – “That in view of the confidential nature of the business about to be transacted (in respect of the personal situation of an employee it is advisable in the public interest, that the press and public be temporarily excluded and they are instructed to withdraw.”

Clerk’s Salary review 2022/23
RESOLVED to approve the increase to the Clerk salary as advised by DALC, this is back dated to 1st April 2022.

There being no further business, the Chairman thanked everyone for attending and closed the meeting at 9:00 pm.

BRETBY PARISH COUNCIL

MINUTES OF THE ORDINARY PARISH MEETING HELD
WEDNESDAY 5th OCTOBER 2022 AT 7:30pm

Present:  Cllr S Toone (Chairman), Cllr M Falder, Cllr M Bridges, Cllr Corner, Cllr Meyrick.

Cllr Haines reported that about 40% of staff are now working in the offices.

The Flooding mitigation scheme has now come to an end; with 19 grants issued for home flood prevention measures.

Local Plan update – the Issues and Options Consultation starts on 10th October, and a plea was made to attend the consultation sessions and to make representations.  200 sites have come forward in the district for consideration. Infrastructure is a major concern and has been included in the consultation documents and this needs to be commented upon.

Flytipping – parishes suffered the most fly tipping are Stenson, Findern, Swadlincote and statistics were given of where the flytippers have travelled from. Credit and thanks were given to the Clean Team for their prompt responses to incidents of fly tipping.

Falls recovery service – SDDC is looking for funding to continue with this service.

Solar panels are being encouraged to be on roofs rather than on fields.

Planning at Knights Lodges was recommended for approval by the planning officers but the applications were rejected by the Planning Committee which thought the applications do not follow the District’s policies; the applications are now to go to appeal.

The Chair paid respect to Queen Elizabeth II.  There were a number of floral tributes left on the war memorial for Her Majesty.

The notice of the casual vacancy was placed and no election called, the parish council may proceed to co-opt to fill the vacancy. The Clerk informed the meeting that Cllrs who fail to attend a meeting within 6 months automatically cease to be a Cllr. There is an exception to this if Cllrs accept the reason for the absence and this is accepted before the end of the 6 month period.

RESOLVED unanimously to extend the 6 month ruling for Cllr Betteridge-Sorby until the next meeting on 10th January 2023 on the grounds of his work commitments,

No one has expressed any interest in the vacancy. Some enquiries will be made if any Bretby Hall resident would be interested in becoming a cllr.

    Cllrs expressed empathy to the frustrations experienced by residents about inconsiderate and bad parking.  Cllr Toone will raise this matter at the Area Forum.
    There have been two bad accidents on Knights Lane which have closed the Lane and the management of traffic in both cases was poor.  This will also be raised at the Area Forum meeting

The Chair and Clerk attended a TEAMS meeting with Richard Hanbury (DCC) in relation to the SID scheme.  The Chair will provide a report at the meeting when decisions on the location and style of SIDs can be made.

Mrs K Kemp resigned on 7th May 2022 as a parish cllr.  The vacancy notice was displayed and the Elections Officer advised on 1st July that the parish council can proceed to co-opt to fill the casual vacancy.
Currently no expressions of interest have been received.  The procedure to co-option to fill the vacancy has been circulated to Cllrs in the Clerk’s Report from July 2022.

MINUTES OF THE ORDINARY PARISH MEETING HELD
MONDAY 4th JULY 2022 AT 7:30pm

Present:  Cllr S Toone (Chairman), Cllr M Falder, Cllr M Bridges, Cllr L Meyrick.

22/885 Apologies
Apologies were noted from Cllr S Betteridge-Sorby.
As a quorum was established, the Chair commenced the meeting.

22/886 Variation of Order of Business
There was no alteration to the variation of the order of business.

22/887 Declaration of Interests:
Cllrs considered their obligations relating to declaration of interests.  Cllr Betteridge-Sorby had previously declared a prejudicial interest in planning application DMPA/2022/0606.

22/888 Public Speaking

a) Members of the Public and Council to comment on any matter
No matters were raised.

b) County Council and District Council members to raise any relevant matter

Cllr Muller reported on the issues relating to the Speed Indicator Devices (SIDs) reporting that the process is putting off a lot of councils from participating in the project; the concerns raised include funding and the type of devices required to be installed.

Freeport – there is nothing further to report.

The Government is looking at Ratcliffe power station plus one other about delaying its closure. Whether this will affect the Freeport status is unclear but the general consensus expressed was that it is unlikely to have a detrimental impact.

Willington power station – the site remains dormant

Cllr Muller reported that DCC has been proactive regarding Ukrainian refuges, numbers are currently about 800 and rising.

Cllr Haines informed of the 2022 community survey, whereby SDDC is asking people who live and visit South Derbyshire to complete a short online survey about its leisure facilities; answers will provide information about barriers to accessing facilities.

This is scam awareness month with particular focus on vulnerable persons.

Area Forums are returning to face to face meetings, with the next being on 19th July 2022 at Ticknall.

In response to a question on the District and County’s views on solar farms, Cllr Muller informed the Central Government opinion may change in response to having to grow more in response to the food crisis. Cllr Churchill expressed an opinion that factory roofs and brown field sites can be used rather than agricultural land. 

Problems with driver sickness at the depot coincides with the holiday season and this has led to missed collections of bins.

7: 52 pm Cllr Muller left the meeting.

Enquiries were made in relation to planning application (DMPA/2022/0520) for 5 holiday lets, as if any conditions can be imposed to have one of the lets to be adapted to accommodate disabled persons.  It is unknown if there is any rules or policy on this, Cllrs Haines and Churchill will make enquiries.

The difficulties within the Planning Dept remain.

There was No Mow May but visibility splays were continued to be mowed and the mowing of other areas has resumed.  So areas have not been mown due to a national shortage of mowers and of spares.  The schedule of mowing can be found on the District Council portal.

The preliminary results of the 2021 Census show the district to be one of the fastest growing areas, this places pressures on the housing stock.  Currently developers are content to put in facilities, particularly GP surgeries whilst the CCG do not have plans to provide any further surgeries, however given changes in costs and the review of Local Plan may alter this.

d)  Parish Council email
Cllr Meyrick circulated a recommendation following the Clerk’s attendance on cyber awareness training; the recommendation also looked at keeping council information secure.  Consideration was given to a dedicated email address for the Clerk and for Cllrs.
RESOLVED to have a Microsoft 365 Business Basic account for the Clerk, it was not considered necessary to have such an account for Cllrs.

The Clerk has no changes to make to the Risk Register. 

b)  General Data Protection Regulations (GDPR)
No changes are recommended and there are no reports of any breaches. 

c)  Parish Cllr vacancy
Mrs K Kemp resigned on 7th May 2022 as a parish cllr.

The Elections Officer has been advised and the Clerk has placed the notice informing of the casual vacancy.  If no election is called by 22nd July, the Council may co-opt to fill the vacancy at the next parish council meeting.

If there is no interest, the vacancy remains and the parish council should continue to advert the vacancy.

If there is interest, the procedure to co-option to fill the vacancy is

  • Interested person(s) write formally to the Clerk to express their interest and to provide a brief statement of why this wish to be co-opted and what skills they can bring to the Council
  • If there is more than one applicant, the Cllrs will vote in the open meeting on each candidate.  Depending on the number of candidates, the Clerk will advise the meeting as to the voting procedure. 
  • Voting is by a show of hands, is open and transparent.  Candidates are entitled to be present.

d)  Parish Council email
A paper will be presented by Cllr Meyrick with the recommendation for security for parish council emails.

Apologies were accepted from Cllr Meyrick (personal), Cllr Muller, Cllr A Churchill.
As a quorum was established, the Chair commenced the meeting.

Cllrs considered their obligations relating to declaration of interests and no declarations were made.

22/871 Public Speaking

a) Members of the Public and Council to comment on any matter
No matters were raised.

b) County Council and District Council members to raise any relevant matter

Cllr Haines reported that there are now three planning technicians manning the phone lines who should be able to take messages.

District Cllrs do not accept that staff are still working from home, rather staff should be in the office or working in a hybrid fashion.  It was reported that SDDC’s CEO is working for people to return to work in a safe environment, but this is taking time. Parish cllrs expressed their concerns and dissatisfaction with the lack of access to officers and in particular to the planning dept.

Grass cutting – there is a supply issue nationwide relating to machine repairs; therefore should the District Council machinery fail, significant delays could occur in the grass cutting programme.  Cllr Falder requested that mowing of visibility splays for the purpose of safety, continues to take place; Cllr Haines agreed that specific areas continue to be mown whilst in other areas for the purpose of diversity, there is participation in the “no mow May” project.

Area Forum meetings should be returning to face to face meetings, with the next round of meetings being held in July.

The Oaklands Solar Farm – no further information was available.

7:41pm Cllr Haines left the meeting.

Bretby Lane was agreed to be the preferred location for speed indicator devices, locations were identified as being just passed the garden centre going down the hill to the 30mph; the other location is at the opposite end of Bretby Lane on the approach to the Winshill island.

MINUTES OF THE ANNUAL PARISH MEETING HELD

Present:  Cllr M Falder (Chairman), Cllr M Bridges, Cllr S Betteridge-Sorby, Cllr S Toone, Cllr G Corner.

1. Election of Chairman
Cllr Falder reported that he will not stand for Chairman.
RESOLVED Cllr Toone was elected as Chairman

2. Chairman to take and sign the Declaration of Office
Cllr Toon took and signed the Declaration of Office of Chair of the Parish Council.

3. Election of Vice Chairman
RESOLVED Cllr Meyrick was elected as Vice Chairman
Cllr Meyrick had sent his apologies and had expressed an interest in becoming the Vice chair.

4. Vice Chairman to take and sign the Declaration of Office
Cllr Meyrick was not in attendance and will sign the Declaration of Office of Vice Chair as soon as possible.

5. Review/Completion of Register of Interests
No changes were made to the Register of Interests.

6. Appointment of Committees – if required
RESOLVED no committees were formed

7. Appointment of Cllrs to External Bodies and arrangements for reporting back
RESOLVED any Cllr will attend any meetings.

RESOLVED the level of insurance cover was agreed and the Clerk was instructed to accept the lowest quote that was available to provide the agreed cover.

13. Review of the Council’s and/or employees’ memberships of other bodies.
RESOLVED to continue with membership of DALC and SLCC.

14. Reviewing the Council’s complaints procedure.
RESOLVED to continue with the complaints procedure with no changes.
