MINUTES OF THE ANNUAL PARISH MEETING HELD
TUESDAY 11th MAY 2021 AT 7:30pm
AT SWADLINCOTE SURGERY, DARKLANDS ROAD, SWADLINCOTE

Present: Cllr M Falder (Chairman), Cllr M Bridges, Cllr L Meyrick, Cllr G Corner, Cllr S Betteridge-Sorby, Cllr K Kemp, Cllr S Toone.

In Attendance: Mrs J Storer – Clerk, District Cllrs Churchill and Haines.

21/768 Apologies
No apologies were noted.

21/769 Election of Chairman
Cllr Falder was nominated by Cllr Bridges, seconded by Cllr Corner.  There were no other nominations.  Cllr Falder was unanimously elected as Chairman.
Cllr Falder thanked all for the support and confidence given to him in his capacity as Chairman and informed the meeting that this will be his final year as Chairman – next year he will step down as Chair but remain on the Council.

21/770 Chairman to take and sign the Declaration of office
Cllr Falder took and signed the Declaration of Office for the position of Chairman.

21/771 Election of Vice Chairman
Cllr Toone was nominated by Cllr Bridges and seconded by Cllr Falder.  There were no other nominations.  Cllr Toone was unanimously elected as Vice Chairman of the Parish Council.

21/772 Vice Chairman to take and sign the Declaration of Office
Cllr Toone signed the Declaration of Office for the position of Vice Chairman.

21/773 Completion of Register of Interests
The Councillors will review their Register of Interest via the Parish Council website and inform the Clerk of any changes.

21/774   Appointment of Committees – if required
RESOLVED it was unnecessary to have any committees.

21/775    Appointment of Cllrs to External Bodies and arrangements for reporting back
RESOLVED that any Cllr can attend any external meeting; reports will be circulated via email and questions an be taken at the next Parish Council meeting.

21/776   To adopt the new Standing Orders
The Standing Orders were previously circulated to all Cllrs.
RESOLVED to accept the Standing Orders, as circulated and without amendment.

21/777   To review the Financial Regulations
The Financial Regulations have been reviewed and no further amendments were identified.

21/778  Review of inventory of land and assets including buildings and office equipment.
The list of assets owned by the Parish Council was reviewed.  No omissions were noted and there had been no disposals during the year. 

21/779  Review and confirmation of arrangements for insurance cover in respect of all Insured risks.
The insurance falls due for renewal on 1st June 2021 and the renewal premium has been received and circulated to all Cllrs.  The insurance company has advised the Clerk that the premium is the lowest possible. The insurance cover provided was agreed and accepted by Cllrs.

21/780 Review of the Council’s and/or employees’ memberships of other bodies.
The Parish Council is currently a member of DALC and will continue to retain membership with DALC. The Clerk is a member of SLCC and this will continue.

21/781 Reviewing the Council’s complaints procedure.
The Complaints procedure as previously circulated was reviewed and no amendments were made.

In Attendance: Mrs J Storer – Clerk, Cllr Haines (to 8:23pm), Cllr Chilton (to 8:23pm), Cllr Churchill (to 8:23pm), 1 member of the public.

20/752 Apologies
Apologies were noted from Cllr Kemp (work commitments).  As a quorum was established, the Chairman commenced and welcomed everyone to the meeting.

20/753 Variation of Order of Business
There was no alteration to the variation of the order of business.

20/754 Declaration of Interests:
Cllrs considered their obligations relating to declaration of interests; no declarations were received.

20/755 Public Speaking

a) Members of the Public and Council to comment on any matter
No matters were raised.

b) County Council and District Council members to raise any relevant matter
The Chairman reported that this will be Cllr Chilton’s last attendance at Bretby Parish Council as she is not seeking re-election in May.  He expressed and conveyed his and the Council’s thanks and appreciation for her work for the parish.

Cllr Chilton asked if reported items from the last meeting have been resolved.
The grate cover on Ashby Road East – this remains a problem and is the responsibility of South Staffordshire Water.  Cllr Chilton will follow this matter.
The drain on the Repton/Hartshorne Road – this has been attended to promptly.
The drain on Knights Lane – this has dried up naturally but will potentially be a problem in the future. No officer has been in contact with the Chair despite his details being provided to officers.
Cllr Chilton reported on the changes within the Highways Dept (DCC) and is hopeful that some of the issues can now be resolved quickly.

Again, only those potholes which are reported to DCC are attended to but do not attend to the potholes that are seen but are unreported. A request was made for the repair team to attend to all potholes in the vicinity.
Cadent – no progress has been made and the resident is now almost unable to access his drive.  A team has previously visited and agreed to repair the bad workmanship on an “if and when” basis however there has been a lengthy wait with no action yet taken.  Cllr Chilton will pursue this.
Cllr Toone commented upon the amount of litter on the side of the A38 and commended a team for the work they undertook to clear litter from various sections of the A38.  A similar situation exists on the A50.
A sign has been erected on both sides of Oldicote Lane sign stating it is a private lane and access is only for residents; this sign is confusing as it has the appearance of an official council sign but isn’t.  An acknowledgement was made that the Lane is unadopted, narrow and difficult to turn a vehicle round however the sign is considered to be not only misleading but also officious; there is a public footpath at the end of the lane and therefore access if permitted. A photo of the sign will be forwarded to Cllr Chilton to follow the matter with Traffic Safety Dept and to make enquiries about obtaining a “No Turning” sign.

There is no stop sign or white lines at the junctions of the Nurseries or at Mount Lane, motorists continue to exit the Nurseries and pay little attention to traffic from the right, this has caused some issues.  There was disappointment that the Nurseries have not engaged to inform motorists to use care when exiting the site.

Cllr Churchill reported on the Freeport announcement made in the budget by the Secretary of State about three sites in the east midlands.  One site will be at Toyota with a rail head and will create about £12m additional business rates and 6000 new jobs.  There will however, be significant blight to residents in the area and SDDC will have to mitigate this for the residents.  For Bretby there could be increase aircraft noise. The Chairman asked for information about what infra structure upgrades will be installed.  The Dept of State and Highways England will make all the surveys and recommendations relating to changes in infrastructure.  The governance structure will come under the D2N2 LEP and there will be consultations for local residents. Flooding in Egginton is acknowledged to be of concern.  The Freeport status will bring significant tax breaks that could be used towards improving the infrastructure.

The appeal on affordable homes on Bretby Lane is still awaited.

The work taking place at 12 Bretby Lane is to be looked at by the Planning Enforcement Team. Cllr Toone reported that some demolition had taken place along with some development that does not appear to bear any resemblance to the original plans. Concerns were expressed about the impact on the telephone line by these works.  Cllr Haines encouraged people to report directly their concerns to the Enforcement Team as well as to Cllrs. The personnel situation in the Planning Dept was explained.
SDDC grass cutting schedule resumes this month.  No progress has been made about the request relating to the specific grass cutting on Watery Lane raised last year,  Cllr Chilton will follow this matter with DCC.
South Derbyshire will be part of a pilot scheme about the recycling of coffee pods.

8:23pm The Chairman thanked Cllr Chilton.  Cllrs Chilton, Haines, Churchill left the meeting.

A member of the public attending from Bretby Hall welcomed the co-operation about the issue of dog mess. The Clerk will continue to press SDDC for information as to when the bin will be installed.
During recent times there have been an increase in the use of the Hall carpark for people visiting the area for exercise and there has been an increase in anti social behaviour.  It was noted that the parish has previously been sheltered from anti social behaviour but is now exposed to it; some of the reported incidents are of concern. The feeling of the meeting was that this situation will continue and is likely to escalate post covid.
The Derbyshire Police Rural Crime publication has provided some guidance along with various contact numbers; this will be forwarded to the resident, however these matters including littering appear to be very low on the priority list for the police.

c) Parish Council Members declaring an interest other than Disclosable Pecuniary Interest wishing to make representation

These were circulated, read, approved and signed as a correct record by Cllr Falder.

20/760 Governance
a)   Risk Register update
There are no recommended changes to the risk register.
RESOLVED to make no changes to the risk register.

b)  General Data Protection Regulations (GDPR)
The Clerk reported that there is no further information, no actions were recommended and there were no incidents to report.

c) Communication Strategy
The matter was deferred.

d)  Arrangements for return to face to face meeting
The Clerk’s report contained information about the future holding of meetings when the legislation for holding remote council meetings expires on 6th May.  There is to be a return to face to face meetings however Cllrs were concerned that other regulations will remain in force, causing conflicts and have the consequence that the holding of face to face meetings will be unachievable.  Cllrs expressed concerns that it may still not be safe to return to face to face meeting, and that by resuming physical meetings it may prevent some Cllrs and residents from their right to attend a meeting.
RESOLVED to acknowledge the legal situation, however  this parish council will meet remotely on 11th May 2021 unless clear guidance is received to the contrary.

Training is being provided remotely via Zoom.  The Clerk attended the DALC “Accounting for parish councils at the year end” training session on 22nd February 2021.

(d)        A resident at Bretby Hall has expressed a desire to join the parish council.  There are no vacancies at present.
A resident who owns Mimi Woods spoke with the Clerk today and the notes of that conversation (as approved by the resident) had been circulated to all Cllrs prior to the meeting.  One suggestion from the resident was to install a bin at an access point to the wood and Cllrs noted that the resident regularly places a black bin for the depositing of dog waste and that the majority of people do not use it to place the waste but discard it irresponsibly.
Similar experiences were noted by other landowners and the dog waste issue has been noted on social media.
It was AGREED that Cllrs Toone and Betteridge-Sorby will meet with the resident to discuss the situation.

(e)        The Clerk was asked to make a request for a speed check/monitor to take place on Bretby Lane.  Examples were given of a particular resident who speeds around the immediate area and information will also be passed to the PCSO.

20/767 Date of next meeting
The next Parish Council meeting will be held on TUESDAY 11th MAY 2021 at 7.30pm; this will be preceded by the Annual Meeting of the Parish Council will be a remote meeting unless there are significant changes to regulations.
There being no further business, the Chairman thanked everyone for attending, wished everyone to be well and safe and closed the meeting at  9:29pm.

Cllr Chilton reported that no further updates have been received relating to the condition of the Bretby Lane verge following works undertaken by Cadent; the promised meeting that would take place with DCC and the affected resident is still to be arranged. Dissatisfaction was expressed about the lack of communication from DCC with the resident.  Cllr Chilton agreed that the lack of communication was unacceptable; Cllrs also made comments on the road having sunk since the works have been completed. Cllr Chilton agreed to take the matter back to DCC as a matter of urgency.  

Disappointment was expressed about the lack of and lateness of gritting around the parish over the last two days when there was significant snowfall. The parish council owned grit bin at Watery Lane is filled occasionally from a store of grit kept at the Chairman’s property.  The second grit bin owned by the parish council is still located at the Chairman’s property and will continue to do so until an acceptable location can be found. Cllr Betteridge- Sorby raised the problems of lack of gritting on Midway Road, and asked that this is classed as a priority road whilst the vaccinations are taking place.

Funding is available from DCC relating to flooding, this information will be passed to the Clerk and the District cllrs.  There are not many properties in the parish that flood, flooding is not happening as badly on Bretby Lane as has been the case in previous years, possibly this is due to the recent planting of trees which appears to have helped to ease some of the flooding matters.

Cllr Chilton was requested to take the following matters to DCC: –
One drain outlet at Bretby Lane is blocked causing the water to back up and flood the lane; this matter goes back to 2019.
On Knights Lane a drain under the lane between Hill Farm and Newton Lane is blocked and floods the lane; it too requires clearing out; this matter is a highways safety issue as the standing water causes problems for traffic particularly if the water freezes.
A grid cover on Ashby Road East rattles when traffic goes over it, the matter has been on the repair list for a significant number of months.

Sub contractors have been seen repairing potholes yesterday and today in the snow.

Cllr Haynes reported that the snow over the weekend has meant no bin collections have taken place; SDDC will endeavour to catch up over the weekend.

Cllr Churchill reported that vaccinations at Oaklands are going well, as have the lateral flow testing centres in Swadlincote. 

Newton Lane is not flooding as in previous years and the recent engineering works appear to be working well; the quality of work was congratulated.

SDDC has confirmed that the verge at Watery Lane will not be cut as per the request of a resident; this request was made to protect the banks of the stream but confirmation on the new arrangement is still awaited from DCC – Cllr Chilton will follow this matter.

The street cleaning team have been seen in the parish, some local residents are using their daily exercise/walk to collect rubbish and the local volunteers collecting litter were congratulated.

Cllr Kemp informed that some residents have expressed a desire to carry out a community litter pick, Cllr Haynes will provide details of how to obtain the necessary equipment for this community activity to happen.

An update was requested on the appeal for the property development at Bretby Lane as it appears that the appeal was lodged after the time scales listed by SDDC in April 2020.

8:20pm Cllr Churchill, Cllr Chilton and Cllr Haynes left the meeting.

20/742 To receive the Chairman’s Announcements
A lorry repeatedly cuts the corner of Bretby Lane and Newton Lane, causing some damage to the newly widened junction.
A wicket gate has been installed near to Bretby Castle, it was established that bee hives are now at this location.
The Church held a socially distance carol concert on Christmas Eve.
The dog bin at the Hall is not large enough to cope with the increase in volume created with increased walking during the covid era/lockdown.

RESOLVED The Clerk was given authority to place an order to buy and install a bin.
The Clerk was requested to make enquiries as to whether the Bretby Hall management company would make any financial contributions.

Mr B Wood has undertaken the internal audit of the parish council’s accounts for several years and as a former DALC Chief Officer, he understands the parish council sector.
RESOLVED for Mr B Wood to be the internal auditor for the financial years 2020/21 and 2021/22.

d) Communication Strategy
The Bretby Facebook page is now receiving daily comments. Cllrs Kemp and Betteridge-Storby have previously discussed how to increase the profile of the Facebook page, including highlighting the community litter pick and once interaction takes place, to establish a social committee and to increase the possibility of organising large events such as Bretby in Bloom.  Details of the Bretby Facebook page will be included in the Church newsletter.      Communication about the Bretby Facebook page was offer to be undertaken by the Neighbourhood Watch.

The Clerk had circulated with the meeting papers, the draft budget and precept for the financial year 2021/22, the budget was discussed having regard to the current economic situation and to the pandemic.
RESOLVED to set the precept for the financial year 2021/22 at £3,658, this being a 2% increase.

Cllr Haines thanked Cllr Falder for laying the wreath on behalf of SDDC on Remembrance Sunday.  The calendar for the bin collections for 2020/21 have been circulated and Cllr Haines will attend the Christmas waste meeting tomorrow and feedback any updates. Recycling remains very heavy and this has affected the green bin collections.
The Shades Farm planning application DMPA/2020/0933 was approved by SDDC Planning Committee with a number of conditions, these were listed to the meeting; building has commenced. The other applications at Shades Farm are submitted under permitted development.  Any concerns about the decisions can discuss these with Cllr Haines.
Cllrs Haines and Churchill have spoken with residents relating to the planning application DMPA/2020/0944 at 252 Bretby Lane and assured residents that despite Covid 19, the planning process remains rigour. The Planning Officer is awaiting information from the Highways Dept.
There was a major flytipping incident on Watery Lane two weeks ago.  The Clean Team was contacted and cleared the site very quickly.  Minor littering and fly tipping continue to be reported to the Clean Team who will follow up any information reported to them.  Flytipping is a problem across the district; particularly badly affected are those areas close to the Derby boarder.

Cllr Chilton reported on personnel changes within the Highways Dept. The number of children now in care specifically related to domestic abuse during Covid has risen.
The Vision Derbyshire suggestion was explained.
Cllr Chilton reported that she has received nothing back from DCC nor Cadent regarding members of the public concerns regarding Cadent quality and inconsiderate workmanship.  One member of the public is considering seeking assistance of the Ombudsman following the lack of response to his concerns.  Questions were raised about how Cadent continues to be failed to be held to account for their allegedly poor workmanship; Cllr Chilton will raise this matter with the new Highways Manager.

The public health roll out of the Covid vaccine has been advised that the Rosliston Forestry Centre is likely to be the vaccine centre for this area, however from a public transport perspective it is a difficult site to access with the buses being periodical and having the result of many people waiting at the vaccine centre for a number of hours.  Cllr Chilton will raise these concerns and feedback any comments via the Clerk.

The Clerk circulated an email on 5/10/20 about how the Council can communicate to its stakeholders, the recommendation is for a communications strategy to be drafted and to consider means of communication as per Cllr Kemp’s earlier suggestion.  A Facebook page has been set up and regular relevant updates are required to encourage people to be involved.  When the Facebook page was set up the Nurseries were invited to participate but they did not become involved, they will be asked if they now wish to contribute, a request will also be extended to the businesses at the Bretby Business Centre.  Promotion between the Facebook page and website will occur.  When Bretby in Bloom takes place, the Nurseries will be approached to assist.  The communication strategy and Bretby in Bloom will be considered in detail in the new year.

A lot of momentum for running organisations and events in the community has been lost with the pandemic and concerns were expressed that this momentum will not return, it is therefore necessary to communicate with the community to encourage others to carry on the community events and activities.

Cllr Haines updated that the Shades Farm planning application has been requested to go before the Planning Committee following the volume of local concerns expressed to both Parish and District Cllrs.  The Planning Officer is waiting for information from the applicant’s agent and it is therefore likely that the application will be brought before the October planning meeting.  The Enforcement Officer is looking at one application as the location of a barn is not in exactly the location as approval was granted.
The Chair provided some background relating to the concerns expressed by local residents during the summer and of the site meeting held with residents, District cllrs and the applicant.
SDDC is still meeting remotely with a lot of officers working from home.
Green bins – the amount of recycling has significantly increased over the last 6 months through Covid; equating to approx. the recycling collections from another 10,000 properties; the contractor has been struggling and there have been some missed collections but the problem has been resolved.
Examples were given of SDDC awarded grant funding projects.
Questions were raised with the funding reserves of SDDC; Cllr Haines reported that funds have been spent through Covid and SDDC awaiting to see what the financial position will be as Covid continues.
There have been major roadworks along Bretby Lane over a number of weeks, these have created problems for residents.

7.44pm Cllr Chilton joined the meeting.

There are traffic lights on Ashby Road East and Bretby Lane in place for work undertaken by Cadent and these lights have been in situ since February and are creating chaos.  The traffic lights are not synchronised and the organisation and execution of the works were considered to be appalling.  One resident has reported damage to his drive caused by traffic being diverted along his drive. Cllr Chilton provided examples of other examples of poor workmanship.  The safety of pedestrians was also thought to be compromised as the signage is not adequate and pedestrians are walking in the path of vehicles.
The Clerk was requested to write to the Highway Hub, copying in Cllr Chilton, to complain about the situation and ask for the officer to come to the location on an urgent basis
The volume and weight of traffic has also made the road sink leaving a significant drop from household drives onto Bretby Lane.
Speeding is still an issue along Bretby Lane between Bretby Nurseries to the end of Bretby Lane.  The Chair gave a short explanation of the attempts made by the Parish Council to have the speed limit introduced.  It is not possible to narrow the road to create a pavement on both sides of Bretby Lane.
The Clerk circulated an email from DCC about the creation of Vision Derbyshire and Cllr Chilton provided further information relating to the forthcoming Government White Paper on devolution.  This Vision for Derbyshire is being put forward to the Secretary of State and if  unacceptable then there is a “Plan B” that Derbyshire joins to form an  East Midlands group.  This may not impact significantly on parish councils; the majority of changes will impact on District and County Councils.

County Council and District Council members to raise any relevant matter
SDDC only just moved to holding virtual meetings last week and there is no indication as to when physical meetings will resume.
There has been some flytipping on pfp 34 which SDDC will be seeking the landowner to clear it.  On Watery Lane a lot of the drains have been cleared and the areas should be in a better position for the winter wet weather.
Flytipping has increased over the CV-19 era and investigations about the culprits will increase following the relaxation of some of the CV-19 regulations.
A new Head of Planning at SDDC has started today – Stefan Saunders.  Some of the larger and difficult planning applications have had to wait until the Planning Committee could meet and whilst the number of planning applications reduced over the CV-19 and some staff at the Planning Dept have been off with illness, a backlog did occurred; however this backlog appears to be reducing following the planning meeting.
A lot of funding has been distributed by SDDC to the community during the CV-19 period, with some being funds from central government being dispersed by SDDC; there have been enormous additional costs incurred by SDDC during CV-19, such as additional staffing costs to maintain the bin collection and for taking the homeless off the streets.  SDDC finances remain excellent and the council is in surplus funds.  During CV-19, a lot of the services have continued.
Rubbish has accumulated in the carpark opposite the Stanhope and efforts have been made to locate the organisation with responsibility for clearing the site, efforts to contact the Environmental Health Dept about this matter have been unsuccessful.  Cllr Haines will pursue this matter.

The application to convert the bungalow on Bretby Lane into a care home has been dropped and it will instead be let as a private residence.

The public footpath at the top of Bretby Lane which goes to Mount Bank is becoming overgrown and the vegetation requires cutting back.  The signposts need to be replaced.  Cllr Toone agreed to report this matter to the Footpaths Officer.

Cllr Meyrick explained the differences between posting information on Facebook and on the Council website, particularly as legislation about accessibility requirements do not apply to social media postings.

Bretby Lane held a street party on VE Day, with residents sitting in their own front garden and observing social distancing; this together with the weekly Clap for Carers has brought the community closer together.

Cllr Churchill reported that SDDC has not met as a council since just before the lockdown; time is being spent establishing what platform is to be used for hosting remote meetings.  The political groups are meeting remotely.  Almost all employees are working from home however some functions are unable to be performed from home such as the rubbish collection; the CEO of SDDC has managed to establish a system to enable all the bins to be emptied.
Nationally there has been an upswing in cyber crimes and encouragement was made for vigilance for people when using the internet.  Similarly, there is the same situation with fly tipping as the waste tips are closed; the reopening of the waste tips will be carefully managed.
Some potholes are being repaired – potholes along Knights Lane and Geary Lane have been attended to.  The potholes along Newton Lane still require attention. Some further potholes and manholes requiring attention on Bretby Lane were reported; Cllr Haynes will take these matters forward.

Cllr Haynes reported the application for 6 homes on Bretby Lane has been refused on a number of reasons.
The grass cutting programme has been very scare but this has been reintroduced particularly along sight lines and at care homes.

Planning application DMOT/2020/0166 has been rejected for the felling of a tree but approval was granted for its pruning,  pruning has not taken place.
The national VE Day celebrations have been cancelled, although individuals are invited to mark and celebrate the occasion.   The Chair will provide bunting for the war memorial to be decorated.  Some residents at the top end of Bretby Lane will be holding a street party, with each households celebrating from their gardens and adhering to social distancing regulations.

The Spotted Facebook group is proving to be popular and was considered to be a means of raising awareness of the Council’s website. The manager at Planters Nurseries will be approached to see if the Nurseries can promote and share the new Council website. Discussions took place about the possibility of having a discussion forum on the website and linking this to the Council’s Facebook page – this will be developed in order to increase interactivity.

The Clerk circulated with the meeting papers, the appendix to the Standing Orders as created by the changes in legislation due to the Covid 19 pandemic
The motion ‘As per Standing Order 26a and the Local Authorities and Police and Crime Panels (Coronavirus) (Flexibility of Local Authority and Police and Crime Panel Meetings) (England and Wales) Regulations 2020, proposes the following changes to Standing Orders until May 2021 or such time as the government revises or revokes the legislation:
3i .. A person shall notify the meeting when requesting to speak by means of speaking to raise the Chair’s attention; the chairman will then invite the person to speak and other Cllrs to listen.
3s …Voting on a question will be by each councillor giving their vote verbally.

RESOLVED unanimously to adopt the amendments to the Standing Orders.

Under the same regulations, there is no need for the Parish Council to hold an Annual Parish Meeting unless it so chooses, the Chair and Vice Chair remain in office until 6th May 2021.  The need for an Annual Meeting of the Parish has been dispensed with this year due to the Covid 19 pandemic, however, this Council held its Annual Meeting of the Parish in March 2020.

Cllr Churchill has made a request for a Flooding meeting to be held soon rather that waiting for the annual meeting, it was reported that it was unlikely that another flooding meeting could be arranged and that a section at the Area Forum meeting will be allocated to flooding matters.  The budget for pothole repairs has been exceeded.

The PCC is making packs available to run a community speed watch session.  These sessions have been run before along Bretby Lane when many local residents were caught speeding. Cllr Haines will forward the details of the scheme to Cllr Kemp who will consider whether the scheme is viable as a means of gathering evidence of speeding along Bretby Lane.

The Clerk explained that the method of providing monthly returns to the pension provider is changing from a paper system to an electronic one. This Parish Council is in the first phase of change.

The Clerk attended a Climate Emergency seminar on 6th March 2020 and provided a verbal report. Whilst the course was aimed at projects that large councils could deliver, encouragement was given for all councils, irrespective of size, to undertake a climate emergency project.

There was a desire for the new website to be interactive and to provide news feeds, and following discussions about the practicalities of monitoring any external postings that maybe made to the website, it was agreed that any interactivity on the website will be for future discussion.   The Chairman will arrange for a notification of the new website to be included in the Church newsletter which goes to all households.

d) To consider information about the former Bretby Castle and how to display the information

This matter was deferred to a future meeting.

e) Bretby in Bloom project

This will be deferred to a future meeting as it is highly unlikely that any events will be hosted during this summer due to coronavirus.

f) Scheme of Delegation

As government advice is changing about coronavirus and public meetings maybe restricted; it was agreed to visit the scheme of delegation to the Clerk to grant the Clerk powers to deal with items which may occur during any period that the parish council is unable to meet.

RESOLVED to grant the Clerk all necessary powers to deal with council business in conjunction with the Chairman and Vice Chairman.  This is an emergency power and will be revisited when the restrictions to social integration are lifted.

2. To receive the Chairman’s report for the year ending 31st March 2020

The main areas affecting the parish this year is flooding, which has left the roads in a poor condition, however DCC has made efforts to remedy the problems on Watery Lane. Knights Lane is in a poor condition; the drain from the land is clear, the problem is with the drain on the road side and water has settled on Knights Lane all year. A please was made to DCC to remedy the problem as a matter of priority. The flooding on Bretby Lane has been corrected but the flooding on Geary Lane has returned. Flooding has resulted in potholes on Newton Lane.

The record attendance of public at the January meeting about a planning application on Bretby Lane for a foster home. As a result a full planning application has to be made. A decision on the other application on Bretby Lane for new housing is anticipated to be given next week, following the submission of further evidence from the developer on housing policy.

The Chairman welcomed all to the meeting and explained the reasons why the meeting venue had been changed. The Chair checked that no one was recording the meeting without first notifying everyone present of any intention to record.

Cllrs considered their obligations relating to declaration of interests.  Cllr Kemp declared a prejudicial interest in the planning application relating to DMPA/2019/1398 – The erection of an extension at 215 Bretby Lane, Bretby, as she is the applicant.

19/641  Public Speaking

a) Members of the Public and Council to comment on any matter

The Chair enquired what the concerns were to the notification for a foster home at 12 Bretby Lane, DMPN/2019/1416, adding a desire that the council is not to be perceived to be operating in a “nimby-ism” manner; he also asked if this is not the correct location, is there an alternative suitable location for a home for vulnerable children.

A resident explained that there are two planning applications relating to 12 Bretby Lane, the one of concern for him related to the certificate of lawfulness for the change of use from residential use to a foster home run by a commercial organisation. He cited previous case law from around the country that this should be subject to a full planning application rather than via a notification. Also, of concern was the location being very close to county boundaries,  as differing authorities and cross boundary services could create communication and logical problems when try to access necessary services; there are also concerns about potential safeguarding through the stated staffing ratios and the vulnerability to some existing residents.

Cllr Churchill explained that he will provide comments/issues raised about this application so that the planning officer can have consideration of these when a decision is made.

Any safe guarding issues need to be considered by DCC and not by SDDC.  Professional advice is being sought by SDDC from specialist lawyers as to whether a planning application is required in this particular case rather than a notification.

Cllr Toone asked for clarification about the SDDC policy relating to certificate of lawfulness – Cllr Churchill will make enquiries about this and report back.

Cllr Chilton explained that she had sought some advice from the safeguarding officers at DCC; it is unclear how DCC would be advised about any possible safeguarding issues relating to the notification.  Cllr Chilton read out the email reply from the safeguarding officer but without details of the notification, the officer was unable to give definitive advice.

The Chair urged members of the public to write individually to the planning dept expressing their concerns.

A second application to build properties at the rear of land at Bretby Lane DMPA/2019/1430 has been submitted and concerns were expressed that if permission is granted to build behind Bretby Lane, a precedence will be created for further applications and future development, of concern is that the local infrastructure is unable to cope with any development of any significant size. The Chair again urged members of the public to make direct representations to the planning dept addressing specific planning concerns.

b) County Council and District Council members to raise any relevant matter

District & County Council

Cllr Churchill provided information of the SDDC community grant that is now open for applications.

A resident kindly volunteers to clear the litter around the Parish but there are some areas that require additional attention, Cllr Kemp informed that she has arranged for volunteers to carry out the litter picking in these areas,  however, the disposal of the collected rubbish required resolving; Cllr Churchill recommended contacting the Head of Operational Services; Cllr Kemp will make the enquiries.

A sign opposite Geary Lane is in the hedge along the A511 and a request for it to be either removed or re-erected was made. Cllr Chilton will report this to DCC.  She also recommended that this and other matters are reported via DCC online.

Min 19/632 Cllr Chilton has checked and confirmed that the historical records could be archived at the Local History section at Matlock.  The Chair will pass this onto the Church Wardens.

The Chair congratulated DCC for the work they have done on Newton Lane relating to flood remedial work.  He reported on what the work had revealed, however whilst the water does now flow, the system is basically inadequate to cope with the amount of work that it is expected to take.

Watery Lane had been blocked and flooded continuously for approx. 3 months, due to a landslip – DCC reported that the landowner was to carry out repair works. The Chair reported that the drain across the road is blocked and needs clearing out; he offered to meet with officers to provide local knowledge about the site.

The pipe under Knights Lane between Knights Lodges and Hill farm requires attention as this section also floods. Cllr Chilton agreed to report this to DCC.

The sewage leak near to the Old Smithy has been temporarily resolved and during 2020, there are plans to renew the pipe, which is approx. 60 years old.

d)  Website compliance

The current website is old and does not comply with the new regulations that came into effect in September 2019. A new website was to be revamped and circulated to Cllrs over the Christmas period.  Cllr Meyrick is the lead Cllr for this project it was not possible for him to attend this meeting; Cllr Meyrick has reported that he is working on the website.

Cllrs recommended that the new website needs to be easily readable on tablets and mobile phones, that it will be useful to incorporate a format so that  forums can be arranged, to have a facility to post comments to the Council and for community engagement – it could be a village website with a parish council page. The Clerk will ask Cllr Chilton if funding from the county council community fund is available to assist with the website construction.

e) To consider information about the former Bretby Castle and how to display the information – Min 19/599

There is an increased need for some signage.

f) To consider the suggestion to set a working party to consider how to mark the passing of a senior royal and the coronation.

The Clerk highlighted that a considerable amount of time and funding is required when marking either the passing of a royal member and/or to celebrate a coronation.  Given the time and funding that maybe required, the Clerk suggested that Cllrs may wish to consider starting the process soon so that funding can be planned and measures can be underway to marking/planning occasions can be proactive and unrushed. It was acknowledged that there is a significant lead time before a coronation but it was agreed that thoughts would be gathered as to how to mark these occasions.  This matter could be something that the new website could raise awareness of.  Cllr Kemp agreed to be the Lead Cllr for this project.

Drainage and flooding were mentioned in the public section of the meeting.  Cllrs noted that flooding had also occurred at Geary Lane and the A511 junction during the period of heavy rainfall.

(a) Accounts for Payment

SDDC undertook a review of the S136 concurrent function refund and as a result of the Finance and Management Committee meeting on 28th November 2019, the following changes were agreed:

  • to reflect the increase in properties across the District since the last review
  • the basis of allocation has changed from Band D properties to the total number of properties in each parish.

The changes aim to provide greater clarity and understanding regarding the allocation and will take effect from 1st April 2020.

Bretby PC will gain an increase in total S136 concurrent function refund of £333.92 (subject still to a formula) and this is to be spent on concurrent functions and not on admin expenses.

RESOLVED Concerns raised in the public section of the meeting surrounding the safe guarding, staff ratios and classification of the notification whether it is C3 or C2 were revisited.  The level of detail contained in the notification is limited and  it was agreed to object to the  application until further information addressing the concerns is received.
