BRETBY PARISH COUNCIL MINUTES OF THE ORDINARY PARISH MEETING HELD

TUESDAY 15th OCTOBER 2024 AT 7:30pm AT ST WYSTANS CHURCH, BRETBY

Present:  Cllr Toone (Chairman), Cllr Meyrick, Cllr G Corner, Cllr Falder, Cllr T Ballington.

In Attendance: Cllr Muller (from 7:44pm to 8:34pm), Cllr Haines (from 7:44pm to 8:34pm), Mrs J Storer – Clerk. 1 member of the public

24/1085             Apologies

Apologies were noted from Cllr Lowe.

As a quorum was established, the Chair commenced the meeting.

24/1086             Variation of Order of Business

There was no alteration to the variation of the order of business.

24/1087             Declaration of Interests:

Cllrs considered their obligations relating to declaration of interests.

24/1088             Public Speaking

  1. Members of the Public and Council to comment on any matter

A member of the public commented on the condition of the bus shelter opposite the Stanhope Arms and the surrounding area.  The area looks tidier following the clearing of the brambles and the installation of a litter bin.

The same resident reported that she had reported a lot of highway matters along the A511 approx. nine months ago with no actions being undertaken to date.  She queried whether the reporting function of the DCC website is no longer functioning.

7:44pm Cllrs Haines and Muller arrived.

A road sign by the Chesterfield Arms says no access to the tip, this is in the wrong place and is untrue; Cllr Muller was requested to take this back to the Highways Dept. Cllr Muller informed that it is taking a long time for any actions to be matters reported to DCC.

Any concerns about signage can be reported to Cllr Muller along with reports of lack of action on reported matters.

Temporary traffic lights were again in position on the Staffordshire section of the A511 when no work occurred, the result being traffic that today was backed up along the Staffordshire section of the A511.

  • County Council and District Council members to raise any relevant matter

Cllr Muller reported the consultation on libraries has finished and a guarantee given that no libraries will close.

DCC has strongly objected to the proposal for the national pylon upgrade.

In relation to the solar farm planning application, concerns were raised that DCC Highways Dept is not recommending any s106 improvements and the lane can accommodate the construction traffic (up to 9000 HGV lorries).   Cllrs expressed frustration and disappointment on the stance taken by the Highways Dept given the condition of Newton Lane has been reported on for several years.

On an enquiry as to why this parish council was not informed about the planning applications for Bretby Nurseries; where there is a significant building proposed with an extension of the electricity supply for the purpose of a vetinary centre, Cllr Lowe had emailed to say that he will make efforts to get the parish council included as a consultee.  

Cllr Haines reported the consultation for the Draft Local Plan is open, responses are encouraged. It is unlikely that a very large development off the A511 is unlikely given other strategic sites have been identified to take the housing allocation from Derby City. There is still an opportunity in the draft plan to prevent coalition of communities.  As well as the identified proposed sites, there are concerns about the quality of the building works on large developments.

Grass cutting has been an issue around the district, however in this parish, verges are not looking too unkempt.

These were circulated, read, approved and signed as a correct record by Cllr Toone.

No items were deemed necessary to be taken with the public excluded other than that listed on the agenda.

24/1091   To receive the Chairman’s Announcements

A small number of repairs to the highways have been undertaken but Geary Lane continues to flood and the service received from DCC Highways Dept is unacceptable.

This had previously been circulated and no matters were raised.

24/1093   Governance

a)   Risk Register update

There are no recommended changes to the risk register.

b)  General Data Protection Regulations (GDPR)

No changes are recommended and there are no reports of any breaches. 

c)  Parish Council elections, vacancies and co-options

There are two vacancies on the parish council and no expressions of interest have been received.

The actual to budget report had been circulated to all Cllrs with the meeting papers.

RESOLVED to accept the report with no queries.

A request was made for a grit bin to be located on Ashby Road East; Cllr Ballington will make investigations about a suitable location.  Any associated costs can be included in the budget for 2025/26.  The precept and budget will be set at the next meeting.

24/1097 To consider Planning Applications

DMPA/2024/1204:

Listed Building Consent for the repositioning and replacement of the communal staircase, installation of a lift and the re-opening of two windows at Communal stairwell to apartments 14 &15 Bretby Hall, Bretby, Burton-on-Trent, DE15 0QQ (18/10/24)

RESOLVED No objections

DMPA/2024/1172

Change of use from dwelling (Class 3) to Children’s Care Home (Class 2) at 2, Stanhope Glade, Bretby.

RESOLVED  to ask for the condition to be imposed on the operator not the dwelling and for the condition to be for a short period of time eg 2 years to provide assurances that the facilities will operate without issue.

There is inadequate parking provision for all staff when there is change over of staff and concerns about where the bins are to be sited. The application makes reference to a park 5 minutes walk away, but there is nothing and this inaccuracy in the application raises concerns about the validity of the other information contained in the application.

DMPA/2024/1106

Variation to DMPA/2024/0211 re extension to Planters Garden Centre.

RESOLVED : objections on the  following grounds

  • Conditions for  the entrance/exit visibly to be improved  are essential 
  • The imposition of a speed limit from Knights Lodges upwards  and onwards to Bretby Lane as more visitors and pedestrians are using the café at Nurseries.
  • Opening hours are not to be changed.
  • To be no extension of lighting either in number or length of time that they are on.
  • No lorries are permitted to wait along Knights Lane, Bretby Lane, Mount Road or Newton Lane prior to  the opening hours of the Nurseries.

DMPA/2024/1052

DMPA/2024/1052 – Installation and operation of a renewable energy generation station comprising ground-mounted photovoltaic panels, inverter/transformer units, DNO substation, site access, internal access tracks, security measures, landscaping, and other ancillary infrastructure at Land west of Newton Lane, Newton Solney, DE15 0RU

RESOLVED: No further comments are to be made.

There being no further business, the Chairman thanked everyone for attending and closed the meeting at 9:08pm.

Both bank accounts are held with Lloyds, who have informed from January 2025 that a account management fee of £4.25 per account per month, will be levied. Interest is only received on the deposit account at the rate of 1%

Having made enquiries, Unity Trust currently pay 2.75% interest on their deposit accounts with no monthly charges, however, Unity require a current account to be opened, which levies a fee of £6.00 per month with no interest.

The recommendation is to open an account with Unity Trust and to transfer all funds across.
