MINUTES OF THE ORDINARY PARISH MEETING HELD MONDAY 9th DECEMBER 2024 AT 7:30pm AT ST WYSTANS CHURCH, BRETBY

Present:  Cllr Toone (Chairman), Cllr G Corner, Cllr Falder, Cllr T Ballington.

In Attendance: Mrs J Storer – Clerk

24/1101             Apologies

Apologies were noted from Cllr Meyrick, Cllr Lowe, Cllr Haines, Cllr Muller. As a quorum was established, the Chair commenced the meeting.

24/1102             Variation of Order of Business

There was no alteration to the variation of the order of business.

24/1103             Declaration of Interests:

Cllrs considered their obligations relating to declaration of interests, no declarations were received.

24/1104             Public Speaking

a. Members of the Public and Council to comment on any matter

No members of the public were present.

    b. County Council and District Council members to raise any relevant matter

    No members were present, the report from Cllr Lowe and Cllr Muller had been circulated via email prior to the meeting to all parish cllrs.

    c. Parish Council Members declaring an interest other than Disclosable Pecuniary Interest wishing to make representation

    None were raised.

    24/1105   To approve the Minutes of the Ordinary Meeting of the Parish Council held on 15th October 2024

    These were circulated, read, approved and signed as a correct record by Cllr Toone.

    24/1106   To determine which items if any, should be taken with the public excluded.

    No items were deemed necessary to be taken with the public excluded other than that listed on the agenda.

    24/1107   To receive the Chairman’s Announcements

    The Chairman referred to the report from Cllr Lowe about planning applications at Bretby Nurseries and the solar farm, both remain outstanding and await a decision. 

    Solar Farm – more information has been submitted in particular about flooding at the site, it was noted water stands on the field following periods of rain.  Parish cllrs expressed their concerns that DCC has failed to understand the impact upon the local lanes and cllrs were disappointed that the Highways Dept report stated the lanes can cope with the construction,

    Bretby Nurseries –  information has been received that the site will not be used out of hours veterinary work.  Whilst construction work has commenced, there is an inadequate electricity supply at the site and currently there is no sign of work to bring electricity to the site.

    Knights Lane – The appeal has only recently been submitted.  A new business relating to wellbeing has started at the site and has been advertised, parish cllrs have been advised nothing can be done in relation to this new business whilst the planning appeal is taking place.

    Temporary traffic lights in position but no working taking place on the highway – temporary traffic lights continue to have a significant impact on traffic along Ashby Road East and latterly at Moat Bank roundabout and continue to present long traffic queues.  The campaign for improvement on this matter will continue.

    The letter relating to the complaint submitted about the lack of enforcement of planning conditions at Ashby Road East, remains unanswered.

    24/1108  To receive the Report of the Clerk

    This had previously been circulated and no matters were raised.

    The location of the grit bin will be between 45-69 Ashby Road East on the bank next to the golf course, this land belongs to the golf course land who has given permission for the grit bin to be located there.

    24/1108  Governance

    a)   Risk Register update

    There are no recommended changes to the risk register.

    b)  General Data Protection Regulations (GDPR)

    No changes are recommended and there are no reports of any breaches. 

    c)  Parish Council elections, vacancies and co-options

    There are two vacancies on the parish council and no expressions of interest have been received.  

    d) Adoption of the sexual harassment policy

    The policy and the associated risk assessment had been previously circulated to all Cllrs.

    RESOLVED to adopt the policy and the risk assessment.

    The Clerk reminded Cllrs that it was necessary to undertake training, the ACAS training can be accessed on line at no costs.  Cllrs were requested to send a copy of the training certificate to the Clerk as confirmation that training has been undertaken.

    24/1109   Drainage and flooding issues

    No matters were raised, the problems remain the same yet no actions have been taken by DCC Highways.

    The flooding on the blind bend on Geary Lane continues with not even temporary signage in place to warn motorists.  Cllrs agreed to allow Cllr Ballington to make enquiries about what can be done about this specific area after she reported on her attendance at the last flood liaison meeting where the priority is to protect homes and flooding on roads is not a priority.

    No requests for funding have been received.

    (c)         To receive the recommendation for the 2025/26 budget and to set the precept for 2025/26.

    RESOLVED to accept the budget as circulated and with no changes.

    RESOLVED to set the precept for 2025-26 at £6150.00.

    (d)        To consider changing of bank accounts from Lloyds to Unity Trust

    Both bank accounts are held with Lloyds, who have informed from January 2025 that an account management fee of £4.25 per account per month, will be levied. Interest is only received on the deposit account at the rate of 1%.  The Clerk provided information of other accounts, interest rates and fees.

    RESOLVED to move from Lloyds Account to Unity Trust.

    24/1112 To consider Planning Applications

    DMPA/2024/1244: Listed building consent for an external wall mounted aerial at School House, The Green, Bretby, Burton On Trent, DE15 0RE (19/11/24)

    Cllr Meyrick has declared a prejudicial interest in this application by email and was not present at the meeting.

    RESOLVED No objections

    Planning Act 2008 (as amended) and The Infrastructure Planning (Environmental Impact Assessment) Regulations 2017 (the EIA Regulations) – Regulations 10 and 11

    Application by National Grid Electricity Transmission (the Applicant) for an Order granting Development Consent for the Chesterfield to Willington Overhead Line (the Proposed Development) (Deadline for responses 29/11/24) – NOTED

    24/1113           To decide if any events will be arranged for the VE day 80th anniversary

    RESOLVED no events will be arranged to commemorate the anniversary.

    24/1114            Consultations

    None received.

    24/1115           Items for information only

    (a)        To receive reports from Meetings attended

    SDDC – Flood Liaison Meeting 15th November 2024 via TEAMS – Cllr Ballington had provided a report during the section about flooding Min 24/1109.

    (b)       Notification of Forthcoming meeting

    SDDC Planning Forum – 14th and 21st January 2025;  Cllr Toone will attend on 14th January.

     (c)       Training Sessions – See DALC circulars which have been provided to all Cllrs

    No training sessions have been attend by Cllrs since the last meeting. 

    The Clerk had completed the online ACAS course on harassment and bullying.

    RESOLVED in view of the confidential nature of the business about to be transacted (in respect of the personal situation of an employee) it is advisable in the public interest, that the press and public be temporarily excluded and they are instructed to withdraw.”

    24/1116           Clerk salary review  

    RESOLVED to award the Clerk the NALC notified percentage increase, backdated to 1st April 2024.

    24/1117           Date of next meeting

    The next Parish Council meeting will be held on MONDAY 10th FEBRUARY 2025 at 7.30pm at St Wystan’s Church, Bretby.   

    There being no further business, the Chairman thanked everyone for attending and wished all a happy Christmas and new year and closed the meeting at 8:27pm.
